I don't think the judge would have released Richards if that were in the works either. I think this is a done deal.

It is certainly an interesting turn of events.
However Prieto may seek cert or a hearing en banc. Since O'Scannlain essentially just said "read Peruta" it essentially takes en banc in Richards off the table since it solely relies on existing stare decisis in CA9. So, maybe the panel assumed that Prieto would petition SCOTUS and that SCOTUS would be able to directly quote Peruta and essential enshrine it as the national standard.

Also, if the panel denies intervention in Peruta and it isn't taken en banc sua sponte then even a stay on Richards doesn't change the fact that all other sheriffs must respect Peruta as law of the land in CA9.
