      This is really the crux of the frustration. It just takes days to pass terrible laws and years of fighting to have them removed. They know they can basically do "human wave" attack of bad laws and drag it out until they get a favorable court composition.

        As more and more cases get through the post-Bruen landscape, the issues at hand will be "settled" which will give courts more incentive to issue quick PIs to stop them in their tracks.

          Fingers crossed that 2024 feels very different from 2023.

                    At this point I would rather he wait until there is finality on what SCOTUS will do in the Illinois case.

                    A decision from Benitez, no matter how well done, only muddies the water right before SCOTUS speaks.

                    If we get a good decision there Benitez can still fill in a lot of the blanks and make his mark. If SCOTUS declines to intervene, we have lost a few weeks, nothing more.

                          They are trying to placate SCOTUS by expediting the case, like SCOTUS demanded in Antonyuk. That doesn?t mean they will rule quickly or obey Bruen. It?s a stall tactic. SCOTUS needs to realize they are at war with the lower courts and states.

                            Hopefully you mean finality on the emergency appeal? Because if we wait for the ultimate finality on that case we will be waiting a long freaking time - like years.

                              I am hoping that SCOTUS will look at what has happened in Antonyuk (expedited briefing, but no action after that) and not be fooled a second time.

                                My opinion is Benitez is waiting for everything to shake out at SCOTUS to turn down the Illinois but SCOTUS might make a statement in rebuke of all the AR and mag bans which he will use to bolster his opinion and hopefully make it harder for the 9TH Circuit to side with California. Benitez is smart and will drop his ruling at the right time.
