    AK build question

I have a question, I'm sure someone here could answer it for me.

If I have an AK parts kit, can I have someone build it for me? Or do I have to build it myself while a more knowledgeable person instructs me on the process?

    Thanks

You already know the answer, but here it is:

Yes they can build it for you, as long as they are an FFL who is legal to manufacture.

You can build it with help, as long as you do the actual manufacture of the firearm. (bend the flat, drill the fire control holes)

    *edit*
You can even build it alone with no help using a rock, matches and big stick

An 07FFL can build it for you and then, if they are not in CA, ship it to your local FFL to DROS it to you.

Posing questions is a kinder, softer way of getting the message out there.

Once you do enough work to the flat to make it a legally recognized receiver, then one can attach things for you, since then it's already a firearm.

I'm not sure thats entirely correct. Most people charge money for work on firearms and that would fall under the action of engaging in business.

                        Per the ATF website

Q: Is a license needed to engage in the business of engraving, customizing, refinishing or repairing firearms?
Yes. A person conducting such activities as a business is considered to be a gunsmith within the definition of a dealer.
                        [27 CFR 478.11]

I'd gather to say that if you are running a website, charging people money, and doing so on a regular basis or actively promoting that activity, you are engaged in a business.

                            Business activity defined as:

Any actions undertaken by individuals or companies, such as buying, selling, marketing, or investing, for the purpose of generating profits or developing economic opportunities

If I was using a website to market my services for the purpose of generating profits or developing economic opportunities I would be engaged in operating a Business.

There is nothing Occasional about ADVERTISING OR MARKETING YOUR SERVICE FOR PROFIT

Not true. An 01FFL can't buy 100 receivers, build them into firearms and sell them. That would require an 07 license and $75 (IIRC) tax on each one built.
