If it's reported stolen then you're SOL. Happened to my uncle. He purchased a firearm and it came back as stolen and was turned over to the sheriff's department. Turns out the owner had misplaced the gun and reported it stolen. He eventually found it but never contacted anyone so when he tried selling it the gun came back as stolen. The guy didn't want to bother with the paperwork or the hassle of getting the gun back and told my uncle "tough luck". Got a small claims judgment but those are pretty much unenforceable so he was out the money. The sheriff's department probably wound up destroying the gun and never filed any charges against the guy. That's probably a highly rare occurrence though.

Once you have that judgement you can have the Sheriff seize property and sell it at auction until you've been paid back.

I know, but I was referring to PPT. Once the Item is paid for and it doesn't go through on the seller side is what I was trying to ask

If your the buyer and gun is stolen you get your money back and cops get the gun. If original owner does not receive his gun back sometimes it goes to the seller. Never a problem for buyer. You may have to sue to get money. Just happened to my hunting partner he bought agun 23 years ago and drosed at b&b sales and sold it to calgunner. It came back stolen cops got gun. My buddy gave money back to calgunner and it is in limbo. They cannot find original owner and detectives say he has a problem they won't disclose, but they would like to interview him.

The seller failing the background check is only an issue if you also fail the check. I wouldn't worry about it if you know you can own firearms.

Don't know the legality or rules.
But since the FFL has the gun, it would make sense that he/she hold the money. For a fee anyway. Escrow.

Not sure what would be required, but if the FFL could setup an escrow system and charge a fee on the sale they would make more money off of PPT.

The FFL doesn't want to be involved with the sale for a PPT, some don't even want money changing hands in the store (Turner's) why would they start an escrow for folks? Too much liability.

It would be more of a safety precaution for both parties if it was like that. Would rather prefer that but I think there would be too much crap involved for them to do and they already complain about the $10 profit margin with them doing a PPT
