Well I'm getting screwed

    Well I'm getting screwed

    So first off let me say, I'm not going to say names or put anyone on blast directly until I pick up my firearms. So I ordered 10 lowers in Dec to beat registration, I told the ffl id pay it off within 30 days which is in a week or so. All was good. I call him today to inform him id be in this week to pay em off and pick em up. He tells me "I sold 6 of em but I have 4 for ya" wtf?! So now he says he may not be able to get the 6 before the 30 day mark and if he does I will have to pay $20-$30 more per lower and pay shipping on em!!! What the ****?! Do I have any legal options?

    Have you give him any money with your order? if no, you got no legal option

          Yes, you have legal options. You can purchase reasonable substitute units and any cost over the agreed price should be paid by the breacher of the contract. Of course you will have to get a judgment against him in small claims court (which takes forever) and pay for the filing. Or you could simply take your business elsewhere and shop with more reputable dealers in the future.

            He's now saying he will give me the lowers and another rifle to make up the difference.

              If you have a receipt that says what you told us, out the rat bastard. That is not the honorable way to handle a business transaction. I would ask for a full refund and explain exactly why you are taking your business elsewhere. You have a receipt, right?

                Yes but the whole reason I ordered last year was to avoid registration, returning the 4 he has would make me go else where and have them registered.

                  What rifle is he offering you? If it's a decent rifle, I would go through with the transaction, then never buy from them again.

                      Sounds like he used your DROS purchase quantity to pre-document/slate inventory for other sales. I saw FFLs doing this during the last few months prior to AB50, even though the buyer had no intent on buying 4 receivers. The FFL then ordered 4, but sold 3 to other people and merely adjusted the numbers on the original buyer's DROS.

                      I think that's how it went; because I was asked to do that by an FFL and I declined.

                        Stop being so concerned about the "registration." I'm guessing it hasn't stopped you from buying pistols in the past, and you aren't never ever going to buy another long-gun from this day on in your life.

                            Somewhat tired of people saying this, not logging the difference.

                            It's a different story when you start talking about magazine-fed semi-Auto modern centerfire Rifles like ARs, AKs, HK91 clones, and FAL clones.

                            Many suspect the new long-gun serialized DROS could be used as a very simple backtrack link should some future law present itself like the "Steinberg Assault Weapon Ban of 2015". Not everyone wants to be connected to that make/model/serial number trail in the advent of such a law wherein anyone with guts will not be lining up like cattle to register non-serialized DROS long-guns (a la Connecticut), so such concerns for these types of firearms is warranted.

                            I am not as concerned about a serialized DROS on a bolt-action/lever-action rifle or double-barrel shotgun, but I WILL be reluctant in the year ahead to DROS anything centerfire, magazine fed/semi-auto.
