    Intercepting firearms from the mail

    Hey guys, got a question for anyone who knows the technicalities of buying firearms online. My brother just bought his first gun online (an antique hunting rifle of some sort) and in a way I won't discuss, acquired the rifle before it arrived at the gun shop. Now I've never bought a gun before but I looked into it and I'm pretty sure it needs it needs to be transferred through a gun shop. I told him he needs to take it to the gun shop or put it back in the mail so it arrives at its proper destination. If anyone can enlighten me to the legal ramifications of doing this that I can pass along, it would be greatly appreciated! Thanks in advance.

          If its truly an antique (black powder) and not a C&R no FFL is required since it's not technically a firearm. Otherwise pack some soap on a rope and some lube, you'll need it in PMITA prison.

            yeah; legal if it is loaded w/o a cartridge (brass, powder, bullet all together already).

            If you pour powder right into the rifle and put a bullet on it and push it together in the rifle; legal.

                It would also be legal if it was made before 1898 even if it takes a fixed cartridge. A good number of modern-looking bolt action rifles had at least some years of production before 1898.

                  Thank you to the others for the actual information. It's not a muzzle loader or pre 1898 so it looks like it does need to go through an FFL.

                    But yes, given the information we have your brother committed a crime, probably a felony. Hell, he probably broke both state and Federal laws. I'm not sure of the right way to unwind it at this point, if it's better to send it back to the originating FFL or just better to walk it over to the original destination FFL and tell them it was misdelivered or something. He still would have committed a crime but at least it would be clear he was trying to do the right thing. I know I'd rather do that instead of waiting three years for the statute of limitations to run out and praying nobody ever looked at the tracking # or wondered why the gun never showed up or whatever. It's an awkward position to be in, but it sounds like it was self inflicted.

                    But really the best thing to do is to call a firearms attorney and ask their advice. If you want a recommendation ask and I'm sure somebody will post the #s for the usual suspects.

                      If it was shipped to a FFL there may be a CFLC number attached to it.
                      At some point in time it will be discovered and tracked down.

                        In any case, bottom line is I think he needs to assume that this needs to be taken care of ASAP.

                            Well we talked about it tonight and decided the best course of action to take was to box it back up and stick it back in the mail, leaving all the original labeling on the box. Thank you for all your input. I came here looking for some talking points to convince him to do the right thing and you guys came through. I think I'll stick around these forums a bit and maybe learn a thing or two. No more trolls

                              Nothing wrong with being gay. I do notice the ones who are most adamant against it and spend the most time talking about it are usually in the closet themselves.
