    Stolen handgun recovered, but...........

    I had a 1911 style 45 acp stolen last year, and it was recovered in February of this year. It was recovered from a parolee during a search.
    1st week or so of March it was shipped off to the DA's Crime Lab for testing to make sure it wasn't involved in any crimes.
    Last week it came back clean, but there is a problem. Aparently the judge ordered it to be used for LE purposes only or destroyed.
    Wonderfull, CA legal gun, never used in a crime, and now ordered to be destroyed, when I was even in court to protest.
    Hopefully the detective assigned to the case can convince the judge to change his mind. But, I'm not holding my breath.

        Afer posting, I decided to not wait for our Property room to send an email to the initial Deputy, so I called the Detective first assigned to the case. He said that as a stolen fierearm it should have been ordered returned to me, and thought that maybe the judge didn't understand that it was stolen. He told me the DA's office needed to file a motion to cancel the order to destroy.
        Soo, I call the DA's office and eventually speak to the Dep. DA who had last handled the case, and got the Parolee to plea out. He told me there was no order to have the gun destroyed, there was an order returning it to me. But there was a 90 hold on the gun, due to a mandatory 90 appeal period. He wanted to know who I talked to and I told the SHeriff's Office Property room and gave him the person's name and number. He said he as going to immdiately call them to tell them there was a hold on the gun till 12-16.
        I've been calling once a month since April to check on it and make sure there aren't any "accidents". Guess it is a good thing I've been doing that.
        Now, I just have to wait till 12-16 and get the gun.

            Wow. Good luck with getting it back, I hope it all works out and you can take it to the range right after picking it up!

            Just curious, and not judging, but was it locked in a safe when it was stolen?

              I hope its like some of those stolen car stories... when you get it back it has ivory grips and gold plated, laser,night sights... and everything you could ever want and more,way more.

                  It was my fault. I had left the gun in the center console of my Yukon and forgotten to lock the doors. I come out of the house the next day and see wadded up tissue paper on the ground around the car. I could see where someone had wiped off the out side of the car in certain areas. Guess the guy was wiping finger prints off the car.
                  There had been a rash of auto "breakins" of unlocked cars in the neighbor hood, and mine was just one of them. I'm getting the gun back, but also lost 4 loaded mags, which were not recovered with the gun.

                    I left my backpack with two handguns and such in it in a Utah hotel ....I called the hotel...they said we found it turned it in to the local sheriff . I called them they said wait 90 days we have to check them out. After three months they sent them to the local PD where I picked them up. No hassle at all.

                          Yes, it will. OP needs to wait until it is available for release, since the LEGR is only good for 30 days.

                              What I have been told is that I do not have to pay the normal $25 fee, since the gun was stolen. Not sure what paperwork is needed. I have also been told the people at the property room will do that for me.
