    I escaped a robbery

    A man twice my size called me over to him in the dark of night. I did not know this man so I continued on. The suddeny I heard footsteps rushing up behind me and tha same man said "boy you better listen to me when im talking to you" and bam! I saw a flash of light as he punched me in the side of my head. I heard oohs and ahhs as I fell to the ground and somehow landed on my back 7 or 8 feet away from my attacker. He the rushed me with both hands forward so I pulled my concealed pistol out and pulled the trigger 3 times rapidly while pointed at his chest. The gun didnt fire so I immediately yelled the words freeze! so that he could see that I had a weapon. He backed up giving me time to get back on my feet. This is where i realized the safty was still on. I stepped back with my weapon pointed towards the ground and he rushes towards me again so I fired a round into the ground near he feet. He then immediately jumped into a push up position as I backed away and got the hell out of the area.

    Any thoughts on how this would have ended for either of us if my saftey were not on?

        Any other stupid reason for not practicing with your carry firearm to reflexively remove the safety at the draw?

        Any thoughts on how stupid it was to fire a "warning" shot?

        Any other stupid thoughts of not holding him and calling the police after being physically assaulted?

        Any other stupid questions to a situation handled stupidly?

              Any link to the local news website? This would have some kind of record and you would have been arrested for firing a warning shot.

                You have a much bigger problem with the warning shot. Also, if at the time of you pulling the trigger you were away from the attacker and he stopped upon the sight of your firearm, that would've been murder. The roles of aggressor and victim change quickly during confrontations.

                At the minimum, take some self defense lessons and learn what is acceptable and legal use of force before you end up in trouble.

                          In California...
                          You would have shot him. Been detained, firearm confiscated as evidence, Trial, aquittal. If you killed him his family would sue you in civil court and if he lived he would sue you in civil court. You may or may not win.
                          The cost...$100,000+
