    Gun was put on hold by the DOJ

    Hey guys, new to this forums so I had no idea where to post this. I recently purchased a firearm and was on my 10 day wait period, on day 9 I get a call from my dealer saying the DOJ put a hold on my gun. Seemed kind of odd since I had made a few other firearm purchases this year alone without any problems at all. (purchases include a handgun and an ar15)

    -Has anyone else ever experienced this?

    -I called the number to talk to a DOJ agent and the phone just rings and rings, sometimes has a busy signal.

    -People who have experience this, how long did it take to resolve and what were some of the issues?

    -I'm aware there is a thread on a lawsuit being filed on the DOJ, I'd gladly join in but id like to get my gun first if I can resolve the issue quickly lol

      No quick resolution that I know of, sorry. My buddy had his pistol put on hold also, it took about two months and then poof, they released it. He got zip for info in meanwhile, even when he did get through to the DOJ.
      Can you punctuate the following?

        Do you know if he kept calling and calling during the 2 months, or did he just let it sit?

          That happened to me last summer. Waited like 3 months for my AR. You need to keep calling. The squeaky wheel gets the grease my friend. You will need to find out why it was placed on hold, and what needs to be done to release it. Then you need to do that.

            Join the over 10 club. Same thing happened to me a few weeks ago. Purchased 6 guns in the last year. A 1911 just 2 months prior to this one. Then, my FFL dealer received the delay/hold letter on day 9. For my current pistol.
            The number you are calling won't get thru. Ask your dealer to give you the other one. Or one of the dealers here on CALGUNS. I don't want to stick my foot in my mouth.

            I spoke to a very polite DOJ field agent (they are called field agents or special agents).

            I wrote about this on a previous thread:

            I bought a Hammerli SP20 RRS shipped from Maine to my local FFL.
            My FFL called and said DOJ placed it on hold.
            The pistol is on the Office of the Attorney general Olympic Exemption list.
            I have clean record. Passed the instant NICS. No liens. All my DMV etc paid. Purchased/received a handgun just 2 months prior. Nothing to stop me.
            I'm guessing that someone at DOJ is not familiar with the exempt Olympic pistols.
            Even though I called DOJ prior to the purchase, my FFL called prior to the purchase and the pistol is specifically designated exempt from safe list and exempt from assault weapons (the magazine is in front of the trigger guard).

            Has anyone had the same experience?

            I'm also guessing that CA DOJ doesn't see these pistols very often.

            Another thing: my FFL received the hold letter but I did not receive the letter I'm supposed to get explaining.

            So now I have $1700 in limbo and want my pistol.

            Can't get DOJ firearms branch on the phone (busy signal or no answer).
            Whatever is going on, I bet it would take all of 30 seconds to clear up.
            I'll be especially not happy if there is a spelling error somewhere.

            I'm venting a bit but if anyone has some insight that I might not have covered or tell me to go have a drink and chill out, I'd appreciate it.

            Do we have anyone from DOJ that visits Calguns or have they been vilified too much?
            And:

            I had a positive conversation with a field agent at DOJ BOF. (My firearm is delayed).
            She was very polite/personable.
            I'm not any better off but I'm now a face to a name. That helps in all interactions in life.
            It really pays to be nice and personable. She might have had people screaming all day at her and this was the one positive call.
            I'm at their mercy.
            She stated that a release time frame depends on where the [hiccup] is, which court venue, what complication or mistaken record and longer if it's from out-of-state. Otherwise they try and get it within 2-4 weeks.
            I mentioned the current record of 160+ days. She was honest about long delays.
            As we all know, there's really nothing they can discuss over the phone and the delay is in the hands of the person doing the background.
            I told her that I have purchased probably 6 firearms in the last year, a pistol just 2 months ago and no problem at all. She stated that it depends on who is doing the background.
            Looks like my luck ran out.
            Anyway, I told her I would share some positive feedback.
            Maybe we made one allie.

              So you still haven't received your pistol? Man I might be ****ed I don't think my gun is on the exempt list. I'll pm you what I bought just in case this place is being monitored by them.

                  This has been going on for the last few years. One got got all pissy on here recently & said no way, but I've heard of it a lot! BS!

                      you do know there is a 30 day period for handguns in ca. you cannot buy more than one handgun every 30 days. if you do doj is gonna flag the dealer and you will have to dros again.

                        Here's a couple of common points that I picked up from other threads on the same subject:

                        1) DOJ seems to have been overwhelmed by workload resulting from the recent gun craze. They appear to have shifted staff from telephone duties to paper processing duties. Very few folks have been successful in making telephone contact.

                        2) DOJ seems to be placing holds on purchases where there is an ambiguity over the purchaser's status, where past practice has been to deny only when a person was disqualified. Couple that with a very long history of poorly maintain records, and you can begin to appreciate the problem. It was very rare that I could go over a "rap sheet" and get a complete picture of a subject's criminal background. Nearly every one was missing important data and it was usually the disposition information on a previous arrest.

                        3) The leading sources of problems seem to be either ambiguity over undisposed arrests, or ambiguity over identity. Whenever I've purchased a firearm, I've always volunteered as much identifying information as possible, even I normally do just the opposite, just to avoid that problem.

                        4) If you're impacted by the record keeping issues, I would strongly recommend contacting the Calguns legal folks. It seems the DOJ is attempting to put the burden for it's incomplete record systems on the firearms purchaser and that's not where it belongs.

                          Haven't received it yet.
                          There are only a few exceptions outside the on-roster.
                          Peace Officer/military.
                          C&R.
                          Olympic pistols (there is a list of pistols from the AG)

                          I've calmed down a bit.
                          I'll wait until week 4 and if nothing happens, I'll take it to the next step.
                          I'm not going to sit idle for 6 months. There are other firearms I still want to buy and this is holding it up.

                              I bought the handgun months ago, but I did buy the shotgun just a few weeks before I bought the pistol (the pistol that's delayed now). So maybe that's the cause, but I thought that that law only applied to pistol purchases. One pistol a month.
