who is at fault and to be charged if one were to buy what was advertised as an 80% lower, only to to find out when they got home that it was a 100% lower? (Ill call it a 99% lower, because it still needs anodizing :P)
So you're saying you didn't look at what you were buying?

Errr, I mean "the person" didn't look at what he/she was buying?

As for not talking about it, nobody in this thread did anything illegal. As for the person on Craigslist, who cares. People breaking gun laws (whether they are good laws or not) make all gun owners look bad in the eyes of those looking to increase restrictions. If he's not breaking the law and just using the wrong image then there is no threat to him.
The point to deleting it would be to stop the further discussion of this

I looked at the AR lower that i bought, it was a completely milled lower, with all parts installed including an upper. Most would call it a full rifle. Made by spikes, bought at my local gun shop.

While looking around on CL today for fun, I found these "80%" lowers that have pictures of complete lowers, minus anodizing. After I found those ads, I came on here to see what people thought about who could/would be charged for buying/selling these.

If it was a sort of "bust" and feds/cops/atf/whoever were selling these, would a noob be at fault for buying one? maybe they read that 80%s were legal, found one on craigslist, not really knowing what it was, and bought it. could the feds bust them for that? or is there just some idiot on CL selling things that he shouldnt be selling?

Pretty sure ignorance of the law does not absolve guilt.

it seems like ignorance on this forum, but i could easily see someone that didnt know much or read into it too much just hear from a friend that "you can get these 80% lowers that just require a bit of work to finish them and its totally legal with no paperwork and no gun shop". so they dont know what an 80% is, they just know that its an unfinished lower part of an ar and they can buy one without a gun shop, 80% lowers are not common outside of the more knowledgeable gun community.

I think that even noobs (if they had done any research at all) would know that buying a completed (i.e. milled from an 80% into 100%) lower from a non FFL w/o BC or DROS is a crime (in California for sure).

If pictures are of a completed lower, the prospective buyer should inquire as to wether it is in fact a fully mulled lower prior to purchase.

That said, it sounds like you merely saw the ad, didn't inquire and are jumping to conclusions about it's 80% or fully milled 100% status. Please correct me if I am wrong.

Nope, you are correct, I didnt bother contacting the seller, just assumed it wasnt an 80% because the mag well, fire control group, takedown pins, mag catch and buffer tube threads were milled.

the OP just asked what would happen if one did buy a 81+% receiver that was advertised on CL as being an 80% receiver. I don't see the problem in the question at all.

The ignorance here is everyone accusing the OP of committing a crime or buying a completed 80% off Craig's list, when all he did was ask a question about it.

If a completed 80% lower has all the correct markings the person who milled it can sell it, thru an FFL, as long as he didn't make it with the intent to sell.

Setting aside the question of legality of such sale.
Even for a noob interested in building an AR, you or anyone else should have done a little research on the project build. How would you know that the built is cut/drilled to specs? Who knows, maybe the seller messed up on his milling process and just wants to make a pass one, without knowing that he's making an illegal sale?

gemini brought up a good point. what if I attempted to mill out an 80, be it ar or 1911 or whatever, and messed up? totally out of spec. Could I sell it then?
