Bought a stolen pistol scenario

So, a son took a pistol from his dad and sold it as a private party transfer through an FFL. The buyer paid the son(thief) already for $950 and went through the deal. Gun was not released after ten days. Buyer founds out that the seller was not the rightful owner and that the gun was stolen.

The son is definitely screwed and in deep sh*t. Spent the $950 somewhere.

Questions are:

Any repercussions to the buyer? Will the buyer be in deep sh*t too? What about the $950?

What now?

I'd ask his dad for either compensation or the weapon. OP didn't specify age, but dad's on the hook to 18.

If sonny's older and if dad's getting the gun back, he can cover his $&ithead son's epic fail and collect it from the loser (in dollars or hide) later.

If not, there's small claims court since the applications for transfer are essentially an agreement to purchase and sell. IMHO

No criminal liability for the buyer, assuming they didn't know the gun was stolen. They have a civil case versus the thief/seller, but it may not be worth the effort, typical thieves aren't easy to collect from.

FFL would have checked and documented the seller's ID to verify seller's ability to legally possess the pistol, so the son would definitely be at least 21.

No, not me. Happened to a buddy that bought a pistol from armslist.com.

So, technically, he can kiss goodbye his $950 + $35 dros unless, the father(original owner) will return the $950+35. Which, he says so. And begging to just let him take care of his own son. Otherwise, go to court for a civil case. Less than a grand might not be worth it.

The guy (thief) was a 25yrs old addict.

A ppt of a sweet little .22 Sentinel pistol I was buying got shut down by an LGS b/c the seller was 20. The FFL said the seller wasn't 21.

There's no way of knowing until the day. Then it's just too much trouble/cost for the buyer to go after.

thats the conclusion i finally came to. i've been searching armslist.com for a few months trying to find a ruger p95 or sr9. found a few, over priced, but timing never lined up to buy them. i finally got tired of looking and went to turners. ruger handguns are a few months back ordered and lots of people have 30% down just to get a phone call when one happens to get to a store. i fondled a M&P9 compact and liked it. jailed it today. no more armslist unless i'm the seller.
