    Please clarify for me.....

    Okay, ive been reading on here until my eyeballs bled, (and found the letter from weiss on the faq section especially informing) but i still have a question.

    From my understanding, and assuming this applies to current date, (04/08) I am under the assumption that you can have a lower reciever thats not on the specifically banned list, as long as the gun does not have any of the other requirements that make it a assault weapon (flash suppressor, pistol grip, collapsable stock, etc). Is this correct?

    Now, my next question..

    Scenario:

    I live in Las vegas Nevada and I have a colt car a3 elite that is legal to own in Nevada. This model is NOT on the specific banned list in california, but if I moved to california and brought it there it would be illegal since with said accessories (collapsable stock, flash suppressor, etc) it meets the criteria of assault weapon. BUT,... lets say I drill a hole through reciever and 10 round magazine and secured it with a machine screw(s). Since it no longer has a detachable magazine, its not legally considered a assautl weapon, even with accessories (collapsable stock, flash suppressor, semi auto, etc) . Is this possible or are you not allowed to convert ANY weapon from detachable magazine to permanetly attached?

    Pesonally, id rather have a gun with a permanent mag than have a detach with no collapsable stock, no pistol grip and no flash suppressor. Just my .02 cents. I'm Trying to be as legal as I can be (like many others on here) without getting my gun taken away.

    Thanks for any info about this.

    Colt is a no-go in CA. It's banned under Category II status.

      Leave the stripped lower out of state and "rebuild" an OLL with your parts. Also, don't drill a hole in your reciever, you can use a bullet button or Prince50 lock.

        That's no longer the case wilit; Harrot v. Kings requires that category two AWs be listed by name - it's where the whole OLL craze came from!

        As others said, don't drill through your receiver, a Bullet Button (replaces the mag button) is enough. Search for anything else you may need and come back here if you can't find it.

          Colt CAR A3 Elite is OFF LIST. It is the only off list Colt I believe.

          Just put a Bullet Button on it and you can keep your features. You can still drop your mag, you just need a tool to do it.

          Not all Colts are banned.

            Well, I learn something new everyday.

            So if the Colt CAR A3 is an OLL, how come no one sells them? I'd have thought people would love to have an actual Colt lower.

              I think the biggest reasons are availability and cost. Other than that, I don't know.

                The following paragraphs (among others) in the AW guide are NOT CORRECT:

                This California Supreme Court decision took effect on August 16, 2000. Under this decision, any firearm of minor variation of the AK or AR-15 type (i.e., series weapon), regardless of the manufacturer, is a Category 2 (Kasler v. Lockyer) assault weapon under the original Roberti-Roos Assault Weapons Control Act of 1989.

                All AK and AR-15 series weapons had to be possessed before August 16, 2000 and must have been registered on or before January 23, 2001.
                To be a cat 1 or cat 2 AW, a weapon must be specifically listed - this per the Harrott decision.

                  The bullet button sounds great, but I thought I specifically read that a bullet
                  or cartridge cannot be considered a "tool" to remove the magazine?

                    The following definitions apply to terms used in the identification of assault weapons pursuant to Penal Code section 12276.1:
                    (a)
                    "detachable magazine" means any ammunition feeding device that can be removed readily from the firearm with neither disassembly of the firearm action nor use of a tool being required. A bullet or ammunition cartridge is considered a tool. Ammunition feeding device includes any belted or linked ammunition, but does not include clips, en bloc clips, or stripper clips that load cartridges into the magazine.
