    Gun Store Nut

    Was coming home tonight with girlfriend and the kids, and saw a gun store I've never been to before. Spencers Firearms, just off the 41 as your leaving Fresno. We turned around since it looked like it was open (all the lights on, and a truck siting out front), and pulled up in a parking stall. Well, thats when it got strange! There was a guy standing by the truck, so we didn't even get out, we just rolled the window down and asked him if they were open. He immediately pulled his weapon and assumes a stance as if he's about to aim and fire at us!!! I'm thinking what the hell, this guy's a nut case!! It was obvious he looked like he worked there, and I asked him if he always pulls his weapon out on people like that?? Needless to say we left in shock, not knowing or understanding what just happened. Looked them up on Facebook and he's the owner!! He'll never get my business, what an idiot!!!

    Why didn't you call the police? If I was with my woman and children calling the police is the LEAST I would do...

      I did call the Madera Sheriffs office, and basically they didn't act like it was worth checking out. I got the feeling that they knew it was the owner and he has probably had some issues there. I always thought it was against the law to draw your weapon unless your life was in danger! So I was surprised by their reaction as well.

          I would have pressed the issue!

          417. (a) (1) Every person who, except in self-defense, in the presence of any other person, draws or exhibits any deadly weapon whatsoever, other than a firearm, in a rude, angry, or threatening manner, or who in any manner, unlawfully uses a deadly weapon other than a firearm in any fight or quarrel is guilty of a misdemeanor, punishable by imprisonment in a county jail for not less than 30 days.
          (2) Every person who, except in self-defense, in the presence of any other person, draws or exhibits any firearm, whether loaded or unloaded, in a rude, angry, or threatening manner, or who in any manner, unlawfully uses a firearm in any fight or quarrel is punishable as follows:
          (A) If the violation occurs in a public place and the firearm is a pistol, revolver, or other firearm capable of being concealed upon the person, by imprisonment in a county jail for not less than three months and not more than one year, by a fine not to exceed one thousand dollars ($1,000), or by both that fine and imprisonment.
          (B) In all cases other than that set forth in subparagraph (A), a misdemeanor, punishable by imprisonment in a county jail for not less than three months.

                        Sounds like they were unloading or loading firearms, in a very vulnerable position, and then a strange van pulls up. The possibility that firearm would be drawn and fired from the open window probably crossed his mind and he probably did fear for his life. Sounds like he quickly assessed the threat and acted accordingly.

                        I bet an armored truck guard would behave in the same way when an unknown vehicle approaches when they are in a very vulnerable position. Running up to a returning guard to ask directions is probably not a good idea.

                        The other day I had to rescue my wife from the freeway. She was feeling ill and could not drive. As I pulled up a CHP officer was already out of his vehicle. As I exited my vehicle he started taking a defensive position, which I immediately recognized and made it clear what my intentions were.

                        I think the lesson is to be cognizant of the situations that one may be putting themselves into, and how you might be perceived.

                              Where did you read that Madera, his girl friend and kids were in a van? To me that conjures up an image of a side windowless box on wheels coming at me with who knows what lurking inside-perhaps a load of bangers with the intent of a firearms heist. No van in the report.
                              I have been in Spencer's store once a few months ago but he was not there, a lady named Monique whom I believe is his wife helped me with my purchase. She was very polite and informative to my questions along with a good pinch or humor in her disposition. Based on her alone, I would go back but now I too have reservations that need answers.
