Felony 187 rule. It does'nt matter if you pulled the trigger. If you had anything to do with a furtherance of the crime and as a result of that aid of a felony crime somebody dies you might as well have pulled the trigger.

The active killer is a psychopath. Smith is simply stupid for agreeing to participate in a robbery.

Is he a coward for not shooting the killer to prevent the murders? I doubt it. I suspect he's the victim of a lifetime of "politically correct thinking" that says - don't get involved - you don't do anything, let the police handle it or if you don't resist a crime you don't get hurt.

The result is that a lot of people are unable to foresee what's about to happen and break out of that non-involvment mentality to stop it.

          That's what's really sad.

            Interesting comments indeed.
Its amazing how anyone can use the words like "victim" and "really sad" to describe a murderer/thief. Last time I checked "politically correct thinking" didn't impair my morality.

Wow. Only facing life in prison and not a bullet to the back of the skull. What is wrong with the kids and what is wrong with the justice system. We need to bring back the widowmaker.

I know a corrections officer who listens to felons talk in prison. They joke about how so many people are conditioned to non-resistance. They also talk about how some people can see what's coming and simply don't react to it, like it's all some kind of TV show instead of reality. One convict told how he was robbing a couple with a younger gang member - who just watched as he shot both of them and "didn't do nuthin'" even when it was time to run. He called it the TV effect because it's like they're watching TV and expect a commerical break after the action.

Is Smith partially responsible for the homicides? Sure. Should he get a death sentence out of it? I think that McGlaughlin certainly should. Smith should certainly serve a serious sentence for his stupidity too.

Doesn't matter much, the death sentencing is put on hold anyway...probably will get abolished since they won't find a non-cruel and non-unusual killing process.

I just say put them in general population. Be nice if all sex offenders and violent criminals were put in prisons like SONA from "Prison Break."

This is why all guns should be banned, What a horrible situation caused by gun companies. Just like the ciggerette companies they sit around killing people all day. We should be more like Great Britain, where guns are banned in cities like London and no crime ever,EVER occurs.

Oh wait, they just stab the **** out of each other instead.
