Sadly, a certain kind of ugliness can occur when someone passes away. However as mentioned here, it is safe not to just assume things.
There should be someone handling the estate. Was this put down on a Will or Trust? That person has a duty to secure property so it is appropriately handled as to the wishes of the deceased. The wishes of the deceased's property will be described. With a spouse no longer able to, this should have been illuminated already as to who that is. If there was no right for this step son to do this, the executor\trustee (only him or her!) should contact this step-son immediately to reclaim the property as to the wishes of the estate, and if not promptly returned I would think then process it like a theft - an unlawful conversion.
