Father deploying, can i take his guns?

    Father deploying, can i take his guns?

    My father is deploying in june to the middle east, and I want to know if I can legally take posession and care for his 3 guns (2 pistols, 1 long gun) till he gets back. And if so what steps do I need to take?

    What do you mean by take possession of? Do you want to transfer ownership to your name?

      Probably just legally possess for mor than the borrow for 30 day rule is what he's wondering

          Wouldn't you just be storing them for him while he's out of the country? Of course they'd have to be exercised once in awhile.

            You really don't need to do anything since it would simply be a loan to you, but if you want to give the state $19 and have the handguns in your name, you can do an operation of law transfer by simply mailing in the form with your money. Long guns are exempt of this and you can perform direct lineage transfers freely as much as you want.

            The only exception to this would be registered assault weapons.

              If the loan of a handgun from parent to child is greater than 30 days then they are required to send in the Intra-Familial/Op-Law form and pay the $19. The son needs to be at least 18 years of age and he needs an HSC. The long guns don't require anything, like you said.

                I'm 23 and own my own handgun and a couple rifles, my 2 younger brothers that still live with my parents (17 and 21) don't ever shoot unless myself or my dad take them. So I was looking into taking his guns into my loving home where they can be loved and nutured like they deserve to be instead of sitting in oil soaked bags sitting in his closet

                  Forgot to add I'm not looking to keep them permanently, just till he comes home at the end of the year. So paying the $19 to get it changed to my name isn't an option.

                    Well getting the title transferred to you wouldn't be permanent, you can always just transfer it back when he comes home.

                      Why isn't it an option. Do you not have the $19 to pay for the temporary loan?

                        INAL, Your father is not selling or loaning you any guns, he is simply storing them at your house. Not a problem.

                          I read your previous post and I guess I mis understood it. I thought if I sent the $19 the guns would be legally under my name. If I fill out the form you talk of I can get his guns loaned to me for more than the 30days correct?

                            In California ownership and registration are two independent things. You can own a handgun, but if you loan it to somebody for more than 30 days it has to be registered to them. Most people have to do this through an FFL, but because of your family relationship the loan between you and your father can be reported with just the Intra-family/Op-law report.

                            Some might suggest not sending in the form since there is not much of a chance you are going to have any kind of police contact during your dad's deployment and if you did have a problem you could just say that your dad loaned you the guns 29 days ago while you were talking to him on the phone. But the guilt you would feel about cheating California out of its $19 would probably eat at you for the rest of your life.

                              Oh the horror! 19x2 when the dad returns as I'm sure he'll want his guns back.

                              Threads like this make me hate California even more. The only worry the OP should have is that of his dad returning home safely, but noooooooo CA has to stick their nose everywhere. In most states "loaning" guns is a worry free process.
