    Class Action Potential?

    I went into a gun shop recently to do a PPT on a pistol. They charged me for a lock, granted it was one penny, but they did in fact charge me for it. Thing is I never received the lock and while I was there picking it up I saw that the same failure had been inflicted upon another picker-upper of a PPT (clearly a used gun and clearly no lock left with it).

    It is my belief that the gun shop in question is routinely charging people for locks that they do not deliver to the customer and is therefore breaking the law continuously and wantonly. They've not been open for long but I was sufficiently dissatisfied with the entire experience that this nagging gnawing at my spirit for getting boned, even if for just a penny meant that something more sinister was happening. It would seem to me that they're selling something for a loss and not delivering it and that such behaviour is destined to be covering up some other sort of mal-action on their part.

    Anyone with lawyerific skillz want to play? If nothing else, I'll end up calling and letting them know I'm aware of their "habit" and unhappy about it and that I'd like my lock shipped to me to save me another 20 dollar drive and that I'd like them to send locks to each other person that they've boned for a penny in the last several months.

    thoughts.

    My thoughts: Yes it's petty (petty as hell but I'm prone to being a dick) but I'm sick of 11 day waits, FUD spreading a-holes behind the counter, poor customer service and flat ripping me off. I don't care if it's for a penny or a pound sterling. It's my money, I spent it on an agreed suite of product and service and was not correctly rendered all of the things that we contracted for.

    No I wont' call them out right yet. i expect they'll maybe see this and get on the bus to making things right. If not, then we'll call them out if legal proceedings otherwise permit.

    EDIT: one other thought strikes me, I don't think that it's incumbent upon me to call them to make things right in the first place. So if I can help slam the door on a hideously bad shop forever, and make a lawyer's day better and maybe put a little coin in my pocket before the great conflagration, what the hell.

      I am a lawyer, and such a lawsuit is not worth my time. When people drop pennies on the ground, no one picks them up. If you think something sinister is occurring, then talk to whoever instituted the policy at the gunshop, you may learn something and realize that nothing sinister is occurring.

        Maybe something to think about but.....if they're just charging a penny it may just be to meet the state requirement. And since most people don't use the gun locks, they don't see a point. Now, if you do need the gun lock, tell them and ask them to give you one.

          Why didn't you just ask them for the lock when you were there IN the store if they did not provide the lock you "purchased"? Class action suit? Really? You have got to be joking.

            The way I see it, they are doing you a favor by charging $0.01 to comply with the sale of a lock to meet delivery requirements.

            I got nailed $19.95 each for two locks at a very high end store on two PPTs. For the same lock you can buy at Walmart for around $5 or less each.

              Sounds to me like you didn't get one of the products you paid for, go back and get your lock that you paid $.01 for.

              By the way, if this is the biggest problem in your life, I'm jealous.

                Yeah go back and tell them that you'd like the lock that you'd paid for. They should then charge you that going rate for the actual purchase of a lock at the store. Do you happen to know of any other shops out there that will charge someone $.01 to take care of the worthless lock requirement? How about just signing a safe affidavit for the safe that you have? I could be completely out in left field. I'm sure that a lawyer will see this post shortly and be chomping at the bit to make this a class action lawsuit and teach that shop a lesson.

                  if it was just me I wouldn't give 2 lumps of cold feces. It's that they do it to EVERYONE rather than let the affadavit play or just giving the lock to those that did in fact pay for it. I asked about the affadavit.

                      Go back and get your lock.

                      I love paying $.01 for locks. I donate them to the shop for the next guy.

                            Yes, but everyone is not PO as you are. They get the concept.

                            If you think he was making money, he would have to have a 100 handgun sales to make a $1. Or 10,000 handguns to make $100. Obviously, it's not money related. It's what several of us have alluded to: Compliance with the law.
