Philthy209 is a stand up guy, I cant imagine him trying to lead someone wrong here. I would advise you to contact him first, and see what he has to say before throwing it out there for everyone to see. If you dont believe it is what was advertised, then say so.

He might be a stand up guy...but his ad is pretty straight forward NOT what he claims it to be.

I can play devils advicate and give excuses for his ad.

Things like, "I meant to say M4 Ramps on the upper, NOT that it was a Colt M4 upper" and "I meant to say Vltor style stock", or "Wow some guy on E-bay sold me a fake Vltor!, I am real sorry."

Maybe send him a PM with a link to this thread. Let him explain / defend himself.

the seller might have been told that it was a colt upper when he bought it and never found out it wasnt, so if he is under the impression that its colt and now that its been in your possession and you are saying its not and want to not do the deal you see were iam going? i think since you started the deal you might need to finish it and learn from it. iam saying in a nice way dont mean to sound assy. good luck

He claims to be very experienced with AR's and this was somewhere around his 9th build that he put together himself.

I'm more or less happy with the upper for what I paid. If we finish what we started, I will be paying about $150-200 more than I already paid for this upper as my smith is definitely worth more than his complete lower. I am fine at $650 for the upper in my possession, but the fact that what I was told I was buying was not what I was buying, makes a difference. Again, I am okay with the deal as it stands, but I don't think I need to feel guilty about not going through with the second half of the agreement.

I have buying/trading -guns/parts for about 36 years.Even from respectable shops,it is buyer beware.Sometimes you are getting what the salesman prefers or what he has left in stock.I try to see where the other person is coming from.In the end I would prefer to be able to look the same person in the face 2 weeks after the deal.Without seeing your upper you already purchased in person,and I assume you have not shot it yet to say if it works good.Try to get out and shoot it.Talk is cheap on the sellers part,regardless of name brands.I have a upper that is mismatch parts,but it is a solid keeping this one shooter.As far as your deal,you are still out a lower.Find a friends lower to try it on.I would hang onto your S&W or trade someone else.You are already set up for stress in this deal.

So Ima sell you a Glock for $500, but gives you a XD instead. But hey, as long as it shoots right?

I agree with your position in terms of having second thoughts on going through with the deal. From the sound of it, he has your money and ammo, but the FFL transfer has not gone through yet? I would give the buyer a chance to sort this out and hear what he has to say. He's a reputable calgunner it seems, though I have personally never dealt with him before. Best of luck to you!

That is correct. He basically got about $650 for his upper. He was asking $1000 or best so I think he should be able to sell his lower for the remaining $350 to make his 1K mark. He felt like his upper was worth more than what I gave him or I was getting a good deal, at least, in his opinion. Honestly, thinking the whole thing through, he planned on doing the transfer at the same time that I picked up the upper, and if that had happened, I would have been completely at his mercy of wanting to make it right somehow. However, as it played out, I ended up being the person in the power chair and realized that I was being /overcharged/lied to and decided to back out on the rest of the deal because I still can.

The way it worked out, I don't think anyone thinks that I got a bad deal, just kind of shady in general the way it played out. We're good bro. No hard feelings as long this thing shoots. Peace.

Just curious, but can you guys can really spot that stock as fake from those small pictures? I noticed it had a little wobble but I've read that is a common issue with most stocks on ARs. Were you all just busting balls or serious?

I noticed the stock right away, but yeah as you get into something like a hobby, you see things like that easy.

There is only two ways to see this,
You built this Ar to make money off of it selling it to a newbish buyer.
Or you bought the rifle from someone and didn't know
A. It's not colt anything.
B. It's a fake EMOD
C. It's a moe grip and tg.


And whatever else is not as described.
Just saying. If you buy something and it's not as described
You return it.
