When does the background check done on a PPT?

    When does the background check done on a PPT?

    Guys,


    1. Is background check being done right there in there when both parties are present on a PPT?

    2. Would both parties ( buyer and seller ) know right away that the
    transaction will go through or not?

    3. Or is there some more background checking that will happen on the 10
    days waiting period?


    Hope to see some feedback from you guys.
    The reason I'm asking is because I will be doing a PPT ( buying a rifle) and the owner is leaving the country for good in less than 10 days.

    Are you asking because you're concerned that you'll be denied?

    Either way, the background check happens sometime within the 10-day waiting period. It does NOT happen right then and there. If you do get denied and the seller is out of the country for good, then I believe after some amount of time (30 days? Not sure) the gun store becomes the legal owner of the gun.

    Hopefully one of our intrepid FFL's will be along shortly with a little more precise information about transactions that are denied.

        Uh, how would the seller be denied? For a rifle (and I think handgun as well) all he needs is a CA legal ID (like a driver's license.) That's it. Done. Unless he's a felon, fleeing from the law (and maybe not even then) it will be hard for him to be denied.

          Correct me If I'm wrong ( newbie question ), Will both the seller and a buyer get checked
          if both parties are allowed to do any firearm transactions? Or it is just the buyer who gets background checked? Thank you.

            Only the buyer needs to meet the requirements (pass background check, etc.) UNLESS the buyer is denied, THEN the seller would need to meet the requirements in order to have his gun returned to him.

              Thank you djleisure for the quick response. I wasn't aware of this. All the while I thought both parties doing the transaction on a rifle PPT are being checked.

                The firearm itself might be denied if the serial # comes up stolen, though, right?

                    Is there really a database in California for Rifles? Or maybe Federal Database?

                      In CA for rifles? Not yet. For any gun reported stolen, yes.

                      For feds, no. Not that BATF hasn't been lobbying for one for decades; Congress keeps cutting $$ for that project out of the bills that fund BATF.

                        All firearms that have had a 4473 form filed on when transferred or purchased is in the federal database. NCIC has info that is how a leo can check ownership of firearm immediately.

                            LOL! FUD!!!!

                            First, nothing from a 4473 is submitted to anyone anywhere. What is submitted is what is on DROS to the state. For long guns, no firearm data is entered. For a handgun, the make, model, type, serial number, and caliber are submitted.

                            Next, on a PPT, the seller is not checked unless the buyer comes back prohibited. If the seller is also prohibited, the firearm is turned over to the local authorities.

                            It is that simple.

                            The FFL usually won't hear back about a problem until the 2-8 day. If there is no problem, then the FFL won't hear anything and will release the firearm when the customer comes back to pick up within 10-30 days after DROS start.

                              Ahh. This part I didn't know. I thought for some reason it would just become the property of the gun shop (like a pawn deal.) Is this true for handguns AND long guns? Any gun that can't be returned to the owner?
