none of it.. they bought it.. i would offer to them that for a small fee, to cover my gas and time (50.00) they can line up another buyer and i will meet the 2 of them at the store to do a new DROS.

Buyer denied for PPT

I know if I sold a car to someone, exchanged $$ for a pink, and their license was suspended with no way to drive it, It wouldn't be my problem.
Are you in any obligation to deal with the situation? I mean, you signed it away and have the $$ Wouldn't the store have an option to purchase it from him on the cheap or turn it into LEO for destruction? Unless there was some sort of extenuating circumstances, i'd be inclined to not participate in the circus.
*If* I took it back (either required to, asked nicely by the store, or felt bad for the guy) , i'd be inclined to withhold $$ for fuel/time - in particular because i'm miles away from any gun shops (typically around 100 round trip, altho there is now a store 50 miles round trip or so).Last edited by DiscoBayJoe; 07-31-2011, 5:37 PM.sigpic Find me on IRC chat at irc.dal.net in room #CGTComment

That is my question too. I don't think so. I would keep the money and get the buyer to work his stuff out...........it would only encourage him to do so. If he can't, renegotiate a return with a pita charge thrown in.

How is that karma at all? The seller took a weighted measure and decided to sell certain items. Does that mean that the buyer should have offered more money than was asked in the efforts of being charitable?Comment

It's happened to me. And unfortunately I spent the money on a new gun so I couldn't refund the guy. He knew this already since I bought a new gun at the same FFL where we did the PPT on that same night, using the money he gave me.
When he was denied the DROS, he said he would figure it out. Almost 2 weeks later, he DROS'd it again so I had to come down to the store to do the paperwork all over again. But at least he paid the DROS fees both times, and even gave me $20 for my troubles towards gas money & time spent going out of my way to help him again.
I also really agree on the used car sale analogy. But selling a firearm in CA is different as the buyer can’t go “test drive” and use the gun while it’s in jail (unless you do the PPT at a FFL with a range). If the gun was never used and still in the same condition you sold it in, then I see very little issues with taking it back and reselling it. Once a car is driven away, I have no idea what the new owner did to it out of my possession. The same goes for a gun that gets out of jail, and then he comes back… but that would usually mean his DROS went through just fine.Comment

I think it'd be fair to charge him $20-30 bucks for your gas and time, depending on how far away, how long it took, etc.
People don't magically fail DROS very frequently, except in mistaken identity cases. They have to know there's a chance it will happen based on their record.sigpicComment

You'd be surprised.
Unpaid registration/traffic tickets/parking tickets are a recurring theme on some threads.
Also, a few months ago someone was denied for violating the 1-every-30 limit even though his 2nd purchase was a PPT. Simply DOJ screwup and they released after he called... but it can and does happen.- Rich

I sold a firearm and did the paperwork. A couple of hours later the gunstore called and told me the buyer was unqualified and they requested that I pick up my shotgun. I picked up the shotgun. The buyer called and I agreed to return his purchase price but he never came to get it.sigpicComment

I sold a gun to a guy who was denied.I gave him all his money back. The gun store made me do a DROS on the gun back to myself just like a PPT.I had to pay $35.00 to DROS it back to myself.I called the guy I sold the gun to and told him what they did and asked him to cover the DROS fee I had to pay.He said no problem and gave me the $35.00 and some extra for the hassle.I thought it worked out great....sigpicComment
