    Crazy HOA President

My wife and I just went to our first HOA meeting for our condo complex because we had an issue we needed to get resolved.
During the meeting one woman got up to talk and he just started yeling that she is not allowed to speak. Well it turns out that he didn't want her to speak because she went to his condo and knocked on the door and he opened the door and put a gun point blank to her head and told her to get the hell outta here or he would kill her. She of course left screaming and called the police who spent 15 minutes trying to get him to open his door and then searched his house, found 6 handguns, and after another 30 min. of searching found the gun he pointed at the woman (he tried to hide it) and he was arrested, spent 1 hour in jail and bailed himself out. I have no idea if he has gone to court yet, nor do I know any other details about the incident.

For a little bit of back story, our HOA president is somewhat mental challenged and has a serious case of what I reffer to as the god complex. He thinks that he has control over everyone's life because he is president. Well for some reason that we can't figure out he has it in for us. Apparently because we don't tell him to shut the F up he thinks we are easy targets and tries to push us around. I can honestly say that we are 1 of the few tenants of our complex that don't cause any problems at all.

Now here is what amazes me....the HOA board has known about this incident for quite some time, and yet he still remains the president! After hearing this story it makes me very uncomfortable to have someone like him in ANY sort of "power" position.

My question was this...if he was arrested for Assault with a Deadly Weapon would the LEO confiscate all his firearms? Would he be allowed to own firearms again?

No. Keep in mind "innocent until proven guilty" and how it plays into the equation here. Now if the LEO's confiscated all of his handguns as evidence, he could get it back. Are you trying to figure out a way to disarm this nutcase? Search up TRO minus the T part.

Well I know that won't work. Somone else in the complex had a problem with another tenatn and tried getting a restraining order, the judge would not issue it because the complex is too small. Just living here would be in violation of the RO

A crazy guy with a God complex as HOA president? The hell you say - I'm shocked!! Next thing you know we'll find out he's petty and vindictive.

Actually, the worst interactions I've ever had to endure is with the HOA Nazi types. Never encountered a more miserable group of human beings. HOA politics reminds me of what Henry Kissinger said about college politics - that they are so viscious because they are unimportant.

I would never, ever live in a dwelling with a HOA. I specifically bought in a neighborhood without a HOA one because of the problems associated with them.

HOAs can be loads of fun - little empires full of little emporers and empresses. I've owned homes in 2 and grew up in 1, all three were pretty good to very good, they can definitely make your life hell though.

Same here. I lived in one when I bought my first house. Never again. Way too many people with control problems, and when you need them to resolve something they didn't come up with themselves they flat out ignore you. I don't see how HOAs are even legal. It is your house on your land.

I believe you might be able to pull off a temporary one.

We'll see how the HOA circus goes when I move into my new place next month. As far as people putting guns in my faces, I don't see it happening...but if it does, I can almost guarantee you that I'll have more ammo than the other guy.

Actually, most condo owners in HOA properties do not own the land their home is on. When you buy into such a place, you do so with the knowledge that you have limited property rights. Sucks, but that's how it is.

Recall the president and possibly the entire board. Talk to the company that manages your HOA to get the proper procedure (its also spelled out in your CC&Rs). I live in a planned development neighborhood and we had a board that was out of control. We quietly gathered signatures for a recall and identified a replacement board. Once we had enough signatures, as well as proxies to elect the new board, we sent the petition to the management company and kicked their butts out.
