Restocking fee for failed DROS?

    I brought this up regarding failed DROS (not me) in general not my wife made me take it back kind of thing. Different? I think so. If you change your mind, then I agree. $50 is fair.

    Let me say it another way. The home you bought. What if the seller wanted $3,000 "good faith" to hold house during escrow? Then, loan company denied you. Yes, even after the "pre-approval" letter anyone can get. I speak this from experience as my ex was a licensed RE agent and we both went to college to get our license back in the late 90's. I just choose a different route. Anyway, so, you have letter in hand, put a $3,000 check down, and the very next day your denied. Your telling me you wouldn't have an issue? Ya, most would. Some may type on here "its all good" but my experience not one person EVER said that in RE contract. Every single person wanted that deposit back. Can we say "complained"? I personally wouldn't get into a contract like that.

      I am with you Jeep. This has become a bogus money grab. Putting a $50 fee is one thing, but 25% of a $600 gun is ridiculous.
      Guess that is the benefit of working with my local dealer and having a good relationship with them. I guess I have a better chance of not getting hosed.

      Added: And about the "restocking" fee, I call BS. They simply take the gun out of the display case and stuff it into the safe. You know... The same freaking thing they do EVERY NIGHT before close and go into the computer and change the inventory from "0" to "+1"... Geesh... Not rocket science.

        You would have to be a fool not to check your status first with DOJ if you kind of suspect that you could be prohibited from purchase.

        If you have never been arrested you know you are good to go. If you know you have some kind of history, check with DOJ prior to attempting the purchase. I get a real kick out of people who say "huh? I can't buy a gun?" Give me a break!!

        NOW, if a mistake is made on DOJ's part, i'm sure a gun store would honor a waiver of policy upon cleaning up the mistake.

          Awww! What if your ex got a restraint order on you and you didn't know? Has it happen? Sure has! I have been around here enough to see those thread post and from my personal career I know this too. It's called a 4hr ex-parte. Now, since the temp order is in, its now hard to get it removed. So, when its time for the perm order, you don't know. You moved. Perm order granted. You go to gun store, and....DENIED. Always another side.

            Real simple, check first! You are supposed to be notified of any TRO. If you dodged the service, you should check prior to purchase.

              What about people that got a 5150 long ago, or even had a restraining order (didn't own guns at the time) and didn't realize the long term effects. Again, I think some people here are not thinking about the average Joe. Many people simply don't know all the ins and outs of gun ownership and how the laws have changed.

              Give you a break???

              ETA: I've read several posts here about a person agreeing to a plea many years ago on the advice of an attorney, not realizing the effects of that one either. Likely the attorney didn't realize everything affected.

                Like i said, if you suspect something could affect the purchase then you have a personal responsibility to check first with either DOJ or the local PD in regards to a TRO. It sure beats paying the restocking fee IMHO

                    You are missing my point. Many people don't have a clue they might be or would be denied. There are a LOT of people out there that actually believe in the 2A, and don't know they can lose it permanently (at this time) for anything other than a felony conviction.
                    There are some people that it's just not worth engaging.

                      Agree.

                      My post was again to show what I saw. I just feel in today's age, we sign things we shouldn't and give up to many rights. We are now a country that just gives up all rights when our fore fathers fought for them.

                      As someone stated, what if you have no idea. Would you just blow $50 to do a check? Doubtful. My wife has got a RO against an ex. Kicked her condo door in. He doesn't know. PD was called, she got the RO. He was gone when they showed. Had no idea that PD was called nor he has a RO on him.

                        OK then for all those out there who have had something in their lives that could possibly prohibit them, go ahead and pay the restocking fee and don't gripe about it. Other wise, pay the one time fee, find out, and know that from that point on in your life, you are good to go. Unless you do something again to prohibit yourself from buying a firearm. To each his own.

                          The NICS check, instead of a 10 day waiting period, would help resolve this situation. You purchase the gun. One phone call determines if you walk out with it that day or not. No returns, no restocking or cancellation fees.

                          Your challenge is with the people that decided you need a 10 day "cooling off" period. Those people are CA legislatures, not gun dealers.

                                What about the kid that gets dishonorable discharge from the military. He/she can never get a gun. I never knew that until recent! My cousin was a kid, and wanted to get married and asked to be "let go" and they did. He can no longer have a firearm. Bummer for him. Again, I bet he doesn't know.
