Restocking fee for failed DROS?

    Restocking fee for failed DROS?

    First let me say, I wasn't denied. Ok...now were passed that. I was in Ammo Bros. They charge $50 restock and $25 DROS fee if your denied. They make you sign a paper. I have never seen this before in all the firearms I have purchased in the many moon rotations.

    Maybe another name instead of "restocking" since you never leave the store or legally purchase it until your cleared through DOJ.

    Just thought I would post on what I saw incase someone goes down there and is also surprised like I was.

    Wow, that's actually a low price. It should be raised. Every gunshop should implement this.

    A prohibited purchaser has taken a gun out of circulation for 10 days (at least) and thrown staff time
    plus overhead for a gun xfer that has to be voided and no profit taken from.

    [Now, if it was a bogus DOJ refuisal and it turns out to be resolved and the gun can later be picked
    up, fine - refund it. But people have the ability to determine if they are prohibited.]

      It makes sense and it doesnt at the same time... I was there yesterday and thought the same thing till I was talking with the guys. Ammo bros pays some one to do the paperwork and file it, then they deduct a weapon out of their inventory and order another one. you then fail your dros for whatever reason, they have a hour or so wrapped up in your paper work, and now 2 guns instead of one. along with any missed sales because yours was no longer available. I also know of some cases where people get WBHA (Wife beats his ***) remorse... where the guy buys a gun goes home, gets kicked in the balls and then comes back and asks for a refund..

        You must be a gun dealer or a business owner.

        I typed out why I disagree. But, erased it and i'll stick with "well agree to disagree".

        I only posted as I was actually surprised. More of a FYI also.

          They always have a restocking fee at all gun shops. Its sometimes really hiden other times not. Most charge 10% to 25%. So $50 is not bad at all my friend was charged like $125 to restock it and the $25 dros papper work. Sorry to here that. But they can charge it.

            On a legal side. How can you charge for restocking if you never owned it? Never removed it from the store?

            As stated, I wasn't denied on DROS. Due to my background, I am good there. I'm not upset neither. lol! It was more of a hummmm, interesting. Turners, Almo Pawn, FFL dealer, Big 5, and a few other local pawns, I have bought from, never saw that in any paper work.

              Ya, I'd have to pull one of my Turner's receipts to get an exact number, but their restocking fee for bugging out of the sale for any reason is over $150 total on a $500-$600 gun. I think it's 20 or 25% plus DROS and the $10 dealer fee.

                Check Turner's again. They indeed do have a hefty restocking fee for a canceled sale.

                  Taking the weapon off the shelf and assuming it is sold prevents a dealer from offering it for sale. (for 10 days)

                  Ammo Brothers is a fantastic gun store. I've bought several weapons (handguns and reloading supplies) from them. 50 bucks is CHEAP for unwinding a gun transaction; losing the display case exposure for 10 days and eating the paperwork fee.

                  The DROS goes to the STATE anyway..so no money to be made for them.

                    I don't know if this counts, I refused to accept a revolver, after the DROS was filed electronically, because I discovered a slight defect. I was not charged for the failed DROS. My LGS ate the DROS fee and ordered me another gun next day air. (Point is I think it depends on who you are dealing with)

                      Surprised? Your lack of information/experience on your part does not indicate invalid status of their policy. In fact many other shops do this and have signs posted.

                      1. I do not own a gun store. I want all good CA gun stores to thrive.

                      2. You say 'business owner' like it's a dirty word. They're not a public
                      service agency.

                      3. What you don't realize is the tremendous amount of paperwork
                      a CA FFL does to sell or transfer a gun. And it can't be rushed or
                      there's risk of loss of FFL if there are errors.

                      4. There indeed may be some drama on difference between ownership
                      and possession, esp if you paid 100% of gun price, tax and fees up front.
                      [This actually was important when we moved against DOJ on seized OLL receivers.]

                        I charge $40 an hour lately for some work. So those fees seem reasonable to me.

                          Jeez. At that point you'd be better off getting it anyway and selling it PPT at a $50 loss. lol.
                          [Before it comes up, haha, this is not buying with the intent to resell since when you first started the DROS and filled out ATF 4473 you intended to buy it for yourself. You are allowed to change your mind during the 10-day ).

                              Because the sign said so and buyer entered into the deal agreeing to it.

                              Ownership is completely irrelevant - a denied buyer engaged the business in a transaction that required time, skill and "float" costs of inventory.

                              Imagine a gunshop that had 25 denied people come in a week. Tell me how long that shop lasts unless they sell a lot of CLP, cleaning patches and rifle cases.
