Give me access to your home and I'm sure I can find some combination of substances or materials that can create an explosive. But that doesn't take into account your intent. Which is exactly what you ignored in the OP.

This is really all the antis have? I suppose they expected the second amendment to list full names and social security numbers!

Ignored? Umm- he did take the intent into question. This thread was specifically started because he INTENDS to possess the material for purposes of making an explosive. :confused

Well, I didn't mean for this thread to turn into another "is tannerite legal" thread. I will just ask someplace else.

don't mess around with tannerite or your own "recipe."

                  CALIFORNIA PENAL CODE
SECTION 12301(b) The term "explosive," as used in this chapter, shall mean any explosive defined in Section 12000 of the Health and Safety Code.

                  CALIFORNIA HEALTH AND SAFETY CODE
SECTION 12000. For the purposes of this part, "explosives" means any
substance, or combination of substances, the primary or common
purpose of which is detonation or rapid combustion, and which is
capable of a relatively instantaneous or rapid release of gas and
heat, or any substance, the primary purpose of which, when combined
with others, is to form a substance capable of a relatively
instantaneous or rapid release of gas and heat.

                  CALIFORNIA PENAL CODE
12312. Every person who possesses any substance, material, or any
combination of substances or materials, with the intent to make any
destructive device or any explosive without first obtaining a valid
permit to make such destructive device or explosive, is guilty of a
felony, and is punishable by imprisonment in the state prison for
                  two, three, or four years.

do you know the VOD of tannerite? do you know how far away it can be heard? are you willing to take the risk that a single phone call could put you in jail for up to 4 years (even longer) with a felony criminal record?

in a post 9/11 world, you can't be messing around with this stuff. everyone is over concerned and it's likely, given the patriot act, that somehow domestic terrorism charges, allegations, etc would be levied against you.

In a letter dated December 28th 2005 Deputy Attorney General Alison Merrilees stated:

"You should also be aware that we intend to add it soon to the DOJ Assault Weapons Identification Guide. Therefore, the Stag-15 will soon be classified as an assault weapon."

                  To Mrs. Merrilees I ask:

                  Whats your definition of soon?

Uh, what was the original question again???

You can procure small quantities of ammonium nitrate from the instant "cold packs" you buy in drug stores. The dry chemical used in them is ammonium nitrate, or NH4NO3. The cold packs don't have a lot of material in them however, so this would end up being an expensive way to acquire more than a few pounds of the stuff.

                    According to the Tannerite website:

                    -----------------------
WHY IS TANNERITE LEGAL? Answer: Manufacturing is a commerce issue governed by the feds. Page 58 CFR 5400.7 General Q&A Section, new edition: #36. When is a Federal manufacturing license required? "A manufacturer's license is needed ONLY by persons engaged in the business of manufacturing explosives materials for SALE, DISTRIBUTION, or for BUSINESS use. For example, persons engaged in the business of providing a blasting service using explosives of their own manufacture would be required to have a license. Persons who manufacture explosives for their personal, NON-commercial use would not need a license."
The above is the law of the land on the use of Tannerite. We feel that it is important to note that in some situations, a person may be in violation and not know it. Such a situation is when a range mixes Tannerite and then charges a fee to shoot it. In this situation, IF the shooter is paying the range owner any kind of reimbursement, renumeration, etc, it is "possible" that the range would be required to be licensed. Thus far, we aren't aware of this being enforced (Using Knob Creek Range as an example, they have been told that they do not need a license to mix Tannerite for the line shooters). All things are subject to change, and we will keep the public informed of any new changes in law. Some states claim that the L&I (labor and Industry dept) or other agencies have authority to regulate Tannerite. This is simply not the case if the shooter is using the targets for personal use.
                    ----------------------------

I have no idea what your legal exposure is, just throwing this out there to add more oxidizer to the fire, heheh.

The OP asked, "Anyone here make their own tannerite?" Tannerite is explosive. He's looking to make explosives.

12301. (a) The term "destructive device," as used in this chapter,
shall include any of the following weapons:
                      (1) Any projectile containing any explosive or incendiary material
or any other chemical substance, including, but not limited to, that
which is commonly known as tracer or incendiary ammunition, except
tracer ammunition manufactured for use in shotguns.
                      (2) Any bomb, grenade, explosive missile, or similar device or any
                      launching device therefor.
                      (3) Any weapon of a caliber greater than 0.60 caliber which fires
fixed ammunition, or any ammunition therefor, other than a shotgun
(smooth or rifled bore) conforming to the definition of a
"destructive device" found in subsection (b) of Section 479.11 of
Title 27 of the Code of Federal Regulations, shotgun ammunition
(single projectile or shot), antique rifle, or an antique cannon.
For purposes of this section, the term "antique cannon" means any
cannon manufactured before January 1, 1899, which has been rendered
incapable of firing or for which ammunition is no longer manufactured
in the United States and is not readily available in the ordinary
channels of commercial trade. The term "antique rifle" means a
firearm conforming to the definition of an "antique firearm" in
Section 479.11 of Title 27 of the Code of Federal Regulations.
                      (4) Any rocket, rocket-propelled projectile, or similar device of
a diameter greater than 0.60 inch, or any launching device therefor,
and any rocket, rocket-propelled projectile, or similar device
containing any explosive or incendiary material or any other chemical
substance, other than the propellant for that device, except those
devices as are designed primarily for emergency or distress signaling
                      purposes.
                      (5) Any breakable container which contains a flammable liquid with
a flashpoint of 150 degrees Fahrenheit or less and has a wick or
similar device capable of being ignited, other than a device which is
commercially manufactured primarily for the purpose of illumination.

                      (6) Any sealed device containing dry ice (CO2) or other chemically
reactive substances assembled for the purpose of causing an
                      explosion by a chemical reaction.
                      (b) The term "explosive," as used in this chapter, shall mean any
explosive defined in Section 12000 of the Health and Safety Code.

Tannerite itself has some legal risk associated with it, but I would suggest that making your own has significantly more. In addition, the cost of making your own is likely to approach that of tannerite itself. It's much easier to explain, "I have this tannerite for making targets," than, "I have a bunch of explosive material for making targets."

                        Tannerite is cool.
                        I buy it.
                        I use it.
I need to buy some more as I am out

If I could make it I would. Let me know if you ever find all the components for sale at a decent price, Virulosity.

I still think this is gray area. by themselves (even mixed) the chemicals are not reactive with each other until the instant that the bullet is delivered. So for that fraction of a second you are breaking the law, just like technically you are somewhat breaking the law when you have a bullet button with no magazine loaded in the gun. for that time frame your rifle has the ability to accept detachable magazines.

12312PC. Every person who possesses any substance, material, or any combination of substances or materials, with the intent to make any destructive device or any explosive without first obtaining a valid permit to make such destructive device or explosive, is guilty of a felony, and is punishable by imprisonment in the state prison for two, three, or four years.

Even having unmixed tannerite looks to be illegal. Not much gray area there...

Further more, i'm not sure what that whole "fraction of a second" thought is about. Breaking the law is breaking the law. Otherwise, everyone would get off for murder, cause you're only killing them for that "fraction of a second" that the bullet enters their brain...

And finally, it's not illegal to have a rifle with an open mag well with the Bullet Button installed. Your rifle is capable of accepting attachable magazines, not detachable magazines. There have been plenty of threads on the subject, if you use the search button.
