It is the buyers job to pay use tax directly to the state, OR the out of state seller can register with the CA-BOE and collect on behalf of the buyer, but the FFL who is merely performing the transfer has no legal right to collect this tax.Comment

Your homework is to go to the CA BOE and look up the regulations which say that FFLs, as a CA business, are considered the retailer of the firearm when it comes from an out of state business. This makes the FFL responsible for paying the sales tax (which they can either pay it out of their pocket or get it from the customer), which is not right, but feel free to go argue with the CA BOE. In addition, the CA BOE changed their view, although not the law, in that now FFLs are told to collect sales tax on firearms coming from out of state even from private parties, unless it is a C&R and the CA buyer has a C&R FFL.
Next, please provide proof that ANY FFL is pocketing the money. The worse thing you can do is to collect sales tax and not turn it over to the state. This is far worse than not collecting/paying it.
BTW, this has been the case for decades, but many FFLs and even more customers were not aware of it.
For items other than firearms, you are correct that the buyer is responsible for paying the sales tax.
BTW, since your comments claim that the business is doing something illegal, which if false, would be consider libel and you could be sued for that. Since you claim that it is illegal to collect the sales tax (as required by law), you have a bit of a problem right there.Kemasa.
