    shooting an intruder?

now i know legally you cant shoot someone unless you felt your life was in danger... but what would you guys do if someone came on your property and tried to steal from you?

last night someone attempted to steal my dirt bike from my back yard... luckily my shift lever is broken and the bike is stuck in 4th gear, so they had to drag it down the street. they got about a block and must have just given up and dropped it. sadly i was asleep and never heard anything happening in my backyard... but now i cant stop thinking like "what if i would have caught them doing it"

would you guys pull a gun on them even if they were unarmed? or call the cops and hope the arrive quickly (on that note... called the cops today to come take a report... took 50 minutes for them to arrive...)

well, i dont really have anything worth a darn but my car and my guns, so if they were stealing my car, no. its insured. ill get paid for it, and human life is valued more highly than my rattletrap pathfinder.

were someone stealing my guns, well, they are then in possession of a deadly weapon, and should they be confronted, they could turn it on me. so, im not sure. it depends on whether i felt my life was in danger. if the dude has an armful and is not in a position to fire, no. otherwise, well, i guess we would just have to see, then, wouldnt we?

in regards to your situation, i dont feel that a broken dirtbike is worth killing someone over.

because the penal code says it is.

i think jesus said something similar, as well. i dunno, it just seems silly to kill someone over something so trivial. now, a good ole fashioned a**-whoopin', that is another story.

what, you want several units to respond w/ lights & sirens to a property crime with no witnesses that happened 8-12 hours ago?

I know how it feels, when I lived in Oakland, the PD wouldn't even show up to take a report in person, but would accept one over the phone if I needed a report # for insurance purposes. I eventually stopped calling ...

              Sorry about your bike.

Look at it this way. If you shoot someone and can't establish that it was legally justified, you will at least be convicted of something like assault with a deadly weapon or aggravated assault. And if the guy dies, you will get tagged for voluntary manslaughter.

As a consequence, you will carry the burden of being a convicted felon for the rest of your life. You might spend some time in jail. You'll probably lose your job and will be foreclosed from many other jobs, because not a lot of employers like to hire convicted felons, especially for responsible, better paying jobs; and certainly you'll be out of luck for any job that requires you be bondable. Oh, and no more guns.

So shooting someone merely stealing from you is a good way to flush your life down the toilet. It's not so much about the value of a scum sucking thief's life; it's about the value of your life.

This is were it gets interesting from my understanding of the PC. As it is very clear we can only use deadly force when we feel our lives are in danger, I don't have the link handy but I also remember that PC allows us to use a weapon to stop a felony...

Well lets say u did go out there without your gun.....and u didnt see at the time but the guy had a gun on him....then what? u get shot. I think if your going to confront someone trying to steal from you, you better be ready for anything. U dont have to shoot the guy to stop him for taking your things.

Depends on the felony and the felon. Tennessee v. Garner=caselaw.

As a legal gun owner, you shouldn't need to ask something like this.
