unless the guy went into rigor mortis before the 5th shell casing hit the ground and then stayed that way permanently i dont think there would be any verifiable way to tell if his hand was raised at the time of the shooting.

but of course im not a coroner so i could be very wrong.

The ATF cleared the agent administratively. He was off duty. The locals can prosecute him if they want.

I was told that coroners insert dowels into bullet holes and manipulate the victim's arms to determine their approximate position when the bullets pierced the body. The holes inside the muscles line up, the dowel goes all the way in, and you know where the arm was.

I want to scream when someone says this! It doesnt work that way. IF you have to shoot because of a deadly threat, you must shoot to stop. To shoot to stop, you must aim for the biggest area. Remember that a person will have their adrenaline pumping and about zero time to take action. If your life is in danger, are willing to risk it all on your panicked marksmenship?

This situation, as written, is a clear example that a set of circumstances can be interpreted mulitple ways. Regardless of who is right, the situation is ambigious. Everyone needs to understand that your actions may be interpreted very differently by a prosecutor.

I agree totally. And, clean shoot or not, sometimes those in the right must take the fall. This ATF agent is actually very lucky he has all these other LE's to band together and be up in arms about this. Think about the many civilians that are involved in similar (or even much clearer) situations that are locked up every year even though they are innocent! They don't have that upper hand that LEO's have with all that support. When a civilian is involved in a self-defense shooting, he/she is guilty until proven innocent in almost all cases.(Regardless of how the law of the land reads, if you you don't know this you live on Uranus) The exact opposite holds true for the police.
