Can I take a gun back from consignment?

Hi Guys,
I feel pretty embarrassed about this. Bought a brand-new pistol and picked it up last monday. I felt some buyer's remorse, and without even firing the gun, dropped it off at the same gun shop to sell as a consignment.

I want the gun back. Will I have to re-DROS and wait 10-days? Since it was drosed on the 8th of Oct., will I have to wait until Nov. 8th?

Did you sign any papers listing the conditions and limitations of the consignment? If so review your papers. You may have to pay the dealer a nominal fee for his troubles and effort related to the consignment.

Since the dealer put the pistol on his books if you pay the fees for his time you will also probably be responsible for an additional DROS fee and will have to wait the 30 days.

Decisions do have consequences. Especially decisions made in haste.

I'm just dying inside from this hasty decision.

I've been doing business with this shop for 5 years. They don't have any written agreement on their consignments. I've dropped off over 20 guns for consignment sales and they have all sold everytime.

This is the first time I want to change my mind. I feel like I screwed myself twice.

At my LGS, when you put something up for consignment, they tell you that if you want the gun back, you have to DROS it back to yourself. Dunno about the 30 day thing, though.

I don't think you have to wait the 30 days again. But you'll have to pay dros again. What did the shop say?

a consignment is like a pawn. you have to wait 30 days (at least in San Diego, you do) for the city to "do a background check", then you can re-DROS the gun back to yourself, pay a "handling fee", and wait another 10 days.

I put a gun on consignment one morning, and I found a buyer myself the very same day for more money. I had to wait 40 days to get the gun into his hands...it sucked.

My advice...you should be talking to the gun store. If you're really that good of a customer, they shouldn't give you any grief. but don't be surprised if you have to DROS or pay a fee....that's just business, plain and simple

Shops sometimes will sit on a gun for 30 days just to see if it comes back stolen. I don't know if its a San Diego thing to wait 30 days tho!!

It was a pistol so the 30 rule may be in order, unless the shop will do it as a PPT.

Not familure with the 30 day rule... for backround check... Not in our county anyways the 30day rule because it's a pistol I don't believe applies as it's a consignment and not a "NEW" pistol. I'd just Contact the shop quickly because it may have already been sold. I've seen guns get placed in the counter 20min after being consigned and they get purchased. THe shop can't sell it under the "new" rule. Prob have to redrose it back to you.

There are lots of reasons why... but this keeps guys from hiding their guns if x wives or the law is after them. So a dros is necessary because there may be a restraining order etc.. and it's just one more way to make sure the guns are ok for you to own. and the state makes money off it. But contact your shop and like has been said you should have some sort of agreement form and copy you signed when they took the consignment.

Starting July 1st, 2010 California Implemented the FDAS (Firearm Dealer Acquisition System). That means that any person that comes into a gun store to sell their Handgun as a consignment or sells it outright to the store must complete the FDAS before that firearm can be resold. There is a waiting Period during this time, I believe it is 30 Days. It's kinda like doing a reverse DROS of the weapon. This does not apply to PPT's.

A shop must hold HANDGUNS for 30 days prior to sale so there is time for it to be reported back as stolen.

Long guns do not have the same requirement.
