    Why the sudden rash of dog/animal topics?

    For a good and relatively non-lethal alternative to a gun, get a sjambok.

        The following is not to be taken as legal advice.

        The case you might want to look at is Fisher v. Carrousel Motor Hotel, Inc., 424 S.W.2d 627, 1967 Tex. LEXIS 267, 11 Tex. Sup. Ct. J. 143 (Tex. 1967). (Restaurant didn't want to serve a black man, waiter knocked plate out of his hand, action for battery against waiter was successful.) It's not going to be conclusive authority for a court in California, but it should be good as a persuasive authority.

        It establishes that an object held in the hand of, or intimately connected to, a person is considered as a part of the person when determining the presence of the essential elements of a battery.

        In this case, assuming that your dog is on a leash, then it is "intimately connected" to your person, and therefore a part of your person. If your dog is being attacked, and you're attached to it, then a reasonable person will likely feel apprehension (if not outright fear) that the attacking dog will continue up the leash to attack the person holding it as well.

        From that sense, it seems like you should be okay for the use of deadly force in defense against an animal, certainly, and quite possibly even against a person who was doing the same thing. But again, this is not meant to be taken as legal advice. You could probably come up with a good argument either way.

          I've tried the various "SWAT" grades of pepper spray on large dogs in a true state of "kill or be killed" fighting.

          None of them worked. In fact, they barely do anything except to get the dog's face wet.

          Bear Spray on the other hand works very well indeed.

            Those are just labels, have you tried FOX Labs?

              No, to be honest I have not. The bear spray works so well, there is no reason to try anything else. I consider my well trained boxer as family. He doesn't start fights. But, there are people that think they have control of their dog(s) off a leash.

              When you have a guard type dog breed (especially on a leash), they will go into defensive mode when approached by other dogs.

              I try to explain to the owners about the leash laws, the vet and medical bills, that he or she will lose their family pet if it "bites."

              And, besides all that, if my dog dies, I'm surely going after the owner with every legal processes available.

                        I've had two encounters with off-leash dogs trying to attack my leashed dog(s). Once with a Rott and once with a pit. OC peper spray (first defence brand) really didn't work even after spraying almost the whole can at it. Attack only stopped after me kicking the hell out of the dog and the dogs owner finaly grabbing his stupid dog. Wanted to spray the dogs owner but then he'd probably let go. Luckily no injury to my dog(s) or me but still makes me violently mad to think about it again. Idiot local cop who I reported most recent incident to said "I would have just shot the dog..."
                        Now on walks I carry a 3oz can of pepper gel. Its sticky, goopy stuff that I'm hoping will blind the dog for awhile as well as sting them. Can says it has about 12-15 feet of range and apx. 15 seconds of spray time. If that doesn't work, I'm now carrying a Kershaw Skyline pocket knife as a last resort. Hope it NEVER gets to that.
                        Bear Guard spray only comes in a giant size can. Hard to carry around but if it came in smaller size (3oz or less) I'd carry it.
                        I think the Taurus Judge would be the perfect dog walking gun. But of course, we can't have it here in CA. Bummer.

                            If a dog attacked me or my kids or wife, I would whip out my knife and disembowel & gut it alive in front of the owner.

                                For the purposes of law and insurance, dogs are property, and that is all you will receive; the initial value of the dog and no more. Spent 70.00 at the pound, get 70.00 as property settlement. There are no other remedies. No seasoned lawyer will take your case as they know there is no more. No increase for "loss of affection", no increase for 3000.00 of vet bills over the years, no increase because you had hoped to one day stud him out. It's long settled law.

                                Think drunk driver kills dog in car accident which is the drunk's fault. Felony drunk driving and dog owner/driver of other car gets value only of dog.
