Ok riddle me this :


I bought a NIB 6906 w/ 2x 12 round mags this year from a FFL01 ( local business - did DROS / HSC / etc..etc... all good so long and thanks for the shoes, etc.. )

is that bad juju ? They are OEM mags w/ the NIB (new in box, basically the pistol had been sitting around the shop since 91 until i bought it ) - do those classify as pre ban ? or are they in violation ?

I only ask because i want to be letter of the law abiding as possible - thanks in advance

If you possessed them in the state of California at any time before Jan 1, 2000, they are legal to bring back into the state. If you did not, then it is illegal for you to import them into CA.

Enjoy the magazines.

The FFL committed the crime at the time of sale, that cannot be undone.
If he did not document the capacity of the magazines in the sales documents, then the DOJ would have a hard time prosecuting him.
BATF doesn't care.

Worst case, some people believe that the buyer can be charged with conspiracy, but that's a very unlikely situation.
Generally, the only time an individual has been charged with anything in relation to high-caps has been when they are arrested on other charges (often trafficking) and it is apparent that the person either imported or assembled the magazines.

If you're really worried about it, disassemble the magazines and either screw a spacer into the bottom of the follower to limit them to 10rds, or purchase some 10rd magazines, and keep the 12 rounders for reassembly when you go shooting outside of California, then disassemble them before returning home.

Possession or use is not a crime.
