      If you Google his phone number, you'll come up with multiple pages of ads on various sites offering to sell (each with a different hard luck story) or build to spec AR's.

        That's exactly what he is doing.

        We have more than a few here who do the same thing. I buy and sell a lot but I certainly don't manufacture with the intent to sell.

          So if you build a lot of ARs and sell them, you're manufacturing but if you just buy and sell whole guns, you're in the clear?

          I think his guns are overpriced for what it is too.

              Nope... "Manufacturing" would simply be another charge added, but would probably only stick (though a DA could certainly charge him in any case) if he were building AK's from flats.
              Technically, you aren't "manufacturing" an AR15, you are simply assembling it from existing parts.
              But both require an 07FFL.

              But if someone is buying and selling on a regular basis, they will be charged with being an unlicensed dealer.
              He's trying to cover himself in his ads.

              Someone gave me this for Christmas and I already have one so I'm selling it.

              That works if it's only a couple of sales a year... but this guy has listed 4 AR's for sale, two of them Rock River lowers, since last October.
              Hell, in the picture of the "lost my job and have to sell it" listing, you can see two more completed lower assemblies on his bench.

                    The three that I listed in addition to the one previous are all right here on the CGN marketplace, listed by the same userID, same garage, and with "cover stories" that make him appear to be selling personal guns out of need.

                        Over 5 transactions/year will definitely put you on the radar.
                        The problem is, the law does not define "infrequent".

                        5 transactions in the 2 months leading up to the holidays and nothing for the rest of the year... then another 5 the next year may very well produce a phone call/visit.

                          What if you buy and sell regularly and trade often? What exactly is the criteria and what is the offense?

                            The offense would be dealing firearms without a license.
                            Pretty serious offense... it would involve multiple charges, including BATF charges on the federal level, in addition to state charges, primarily BOE charges for an unlicensed business and failure to pay sales tax, and probably IRS tax evasion charges for failure to report income from sales.

                            As far as 5 transactions in a fiscal or rolling year... again, the law does not specify.

                                20+ iTrader ratings on a forum that has been around since 2003, and that promotes the buying/selling of items besides firearms is nothing.

                                I've got a +3, should be a +4 but the seller never left FB... none of those 4 were firearms. Only one could even be considered a "weapon" (knife).
