Saying "I have noting illegal in my car" is NOT invoking your right to remain silent. What you are doing is issuing a statement which, if later found to be untrue, may be used against you (the defendant lied).
If you really want to stand on your rights, be direct.
Officer, I have the right to remain silent and not answer any of your questions, especially those questions not related to the reason you stopped me. I'm going to exercise that right with discretion.
This allows you to answer questions like "is this your current address?" or "Is this vehicle registered to you?" as a courtesy to speed things along.
Courts have held that invoking your 1st, 4th or 5th amendment rights is not sufficient to give officers PC for a search. Of course, officers can say that they developed their PC some other way too, but often times a court will see it as barely plausable.
If an officer seizes property, besides a receipt, he had better be able to point to PC section that allows him to do so.
In most cases, if the officer inspects your firearm and you claim it is yours, that's pretty much the end of it. If he claims he's inspecting it under 12031(e) to ensure it is unloaded, he can't detain you afterwards while he runs the serial number - unless he's detaining you for other reasons, such as to write you a traffic ticket.Comment
