My bet is that it is simple decorum and etiquette. Benitez obviously knows the 9th is corrupt AF. But to a large extent, that is above his pay grade. It is very customary in cases to grant stays when asked and/or when they know there is going to be an appeal.

And I get it...with the corruption of the 9th one can easily make the case that we owe them nothing and Benitez should not grant the stay. But that just sends the whole process into further decay IMO. If one side begins not granting stays then the other side will follow. And there will be future cases that don't go our way and we will want a stay to give time for our side to appeal. Not granting stays can easily work against us in the future.

I read it through, and from what I understand, it's not the court that defines an "assault weapon". The court is telling CA that CA's definition of "assault weapon" is a meaningless, made up, and unconstitutional, which many on this forum probably agree. The court basically says that the assault weapon definition is based off of looks, and that other featureless semi-auto rifles, and non-threaded barrel pistols are ok but just because a pistol has a threaded barrel on it or a semi-auto rifle has a pistol grip, makes it an assault weapon-does not make a spec of sense.

It doesn't matter. The 9th could agree w/Benitez and say AW bans go against the 2A, but CA will just turn around and enact some other backdoor law or fee or permitting/licensing scheme to delay and make it crazy expensive to shoot.

SCOTUS ruled in Bruen that CCW is the law of the land. How many counties are still over a year to issue? Even if they issued on the spot, what will happen on 1/1/24 due to SB2?
