    Magazine repair

    Hey guys, I tried to search my question, but can't find any info.

    My 30 round pmag have a crack on the magzine body. Can I use a blocked 10 round magazine body repair my 30 round?

      Assuming you reside outside of California in a free state, I'd say that depends on your skill level. If you reside inside of California, Penal Code 32310 prohibits you to own a magazine holding more than 10 rounds, with few exceptions.

        Remember some have the date cast into the plastic so saying you purchased during freedom week can be proven false.


        Between the hours of Friday afternoon on March 29, and 5:00 P.M Friday, April 5, hundreds of thousands—if not millions—of magazines capable of holding more than 10 rounds were lawfully purchased by California gun owners. Referred to by many as “Freedom Week,” this was a direct result of a federal district court issuing a decision in the NRA and CRPA supported lawsuit titled Duncan v. Becerra, which permanently enjoined California from enforcing its restrictions against so-called “large-capacity” magazines.

        ARTICLE 1. Rules Governing Large-Capacity Magazines [32310 - 32390] ( Article 1 added by Stats. 2010, Ch. 711, Sec. 6. )

        32310.


        (a) Except as provided in Article 2 (commencing with Section 32400) of this chapter and in Chapter 1 (commencing with Section 17700) of Division 2 of Title 2, any person in this state who manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or exposes for sale, or who gives, lends, buys, or receives any large-capacity magazine is punishable by imprisonment in a county jail not exceeding one year or imprisonment pursuant to subdivision (h) of Section 1170.

        (b) For purposes of this section, “manufacturing” includes both fabricating a magazine and assembling a magazine from a combination of parts, including, but not limited to, the body, spring, follower, and floor plate or end plate, to be a fully functioning large-capacity magazine.

        (c) Except as provided in Article 2 (commencing with Section 32400) of this chapter and in Chapter 1 (commencing with Section 17700) of Division 2 of Title 2, commencing July 1, 2017, any person in this state who possesses any large-capacity magazine, regardless of the date the magazine was acquired, is guilty of an infraction punishable by a fine not to exceed one hundred dollars ($100) per large-capacity magazine, or is guilty of a misdemeanor punishable by a fine not to exceed one hundred dollars ($100) per large-capacity magazine, by imprisonment in a county jail not to exceed one year, or by both that fine and imprisonment.

        (d) Any person who may not lawfully possess a large-capacity magazine commencing July 1, 2017 shall, prior to July 1, 2017:

        (1) Remove the large-capacity magazine from the state;

        (2) Sell the large-capacity magazine to a licensed firearms dealer; or

        (3) Surrender the large-capacity magazine to a law enforcement agency for destruction.

          A6: Whether the scenario you describe constitutes repairing or manufacturing a large capacity magazine depends upon the legal opinion of the prosecutor in the jurisdiction where the acts occur. There are 58 district attorneys ih California’s 58 counties. They could elect to prosecute you for a felony (Penal Code 12280(a)(2)), if they believed that you were manufacturing a large capacity magazine.

          Q 7: If the magazine body is replaced with one clearly manufactured after 2000. . . is there any burden of proof upon a Calfornia resident that they did in fact replace a worn/obsolete part and did not illegally purchase/import a new hi-cap magazine.
          A7: A California resident who repairs a large capacity magazine that was owned before January 1, 2000 does not have any “burden of proof’ that the magazine was repaired, rather than replaced with a new magazine. However, it would be prudent in such a case to keep records documenting the purchase of the part necessary for the repair in order to demonstrate that the large capacity magazine was repaired, not replaced.

          Q8. Can you use parts designed for a 1O-round magazine to repair a legally obtained hi-cap magazine?
          A8: If parts designed for a 10-round magazine are interchangeable with parts of a legally obtained large capacity magazine, there is no legal barrier to using them.

          Q9: Can you have enough spare parts to assemble a new hi-cap magazine provided they are unassembled and intended for use as replacement parts?
          A9: Whether the scenario you describe constitutes possession of magazine parts with the intent to manufacture or with the intent to repair a large capacity magazine depends upon the legal opinion of the prosecutor in the jurisdiction where the acts occur. You could be charged with a felony (Penal Code 12280(a)(2)), if a prosecutor believed that you were manufacturing a large capacity magazine.

            That earlier Calguns thread, and the California DOJ Letter on which it was based, are both now completely worthless.

            Please note that the DOJ letter was authored in 2005.

            The current law prohibiting the manufacture of a Large Capacity Magazine, and defining that manufacture to include the swapping of magazine bodies went into effect in 2017.

            You gotta be careful to stay up-to-date with this stuff.

                Here's the law that prohibits removing them. Quoted from Penal Code section 537e:

                "Any person who knowingly buys, sells, receives, disposes of, conceals, or has in his or her possession or any other distinguishing number or identification mark has been removed, defaced, covered, altered, or destroyed, is guilty of a public offense, punishable as follows..."

                Please note that the date code is a "Distinguishing Marking" that identifies the date of manufacture.
