    Sales tax question

    Just bought a gun that was on consignment at a local shop. Why is it that there is no sales tax on a PPT but there is on a consignment sale?

    Because the dealer is storing the gun and using their people and facilities to promote and process the sale of it.

      Because the dealer is not selling the firearm. As in, taking the money.

        It's California. You buy something you owe sales tax.

        If the dealer does not collect it, you still owe the tax.

        When you file your taxes there are forms for all out of state purchases and untaxed transactions.
        Rule 1- ALL GUNS ARE ALWAYS LOADED

        Rule 4 -BE SURE OF YOUR TARGET AND WHAT IS BEYOND IT

          Inbound freight is taxable, outbound freight is not

                A consignment sale is a sale of a item conducted by a third party (that is a business) for a person who gave permission to sell the item.. A PPT is a private transaction between two private citizens. There is no money exchanged between the buyer seller and shop for the item being sold. They only use the business for the legality aspect as directed by law and pay any required fees for the DROS. If there was no legal need need to do a DROS the FFL would have non part in the transaction,


                I expect any day now for the state to start requiring the FFL to collect use tax on the sale like the dmv dies for car sales

                        While the rest is true, the first sentence is all that is need to explain things.
                        Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.
