MCK Roni with NFA stock illegal?

Can you legally possess an MCK roni with a NFA stock? Does it become an SBR when you insert your handgun?

I believe you are correct, but I wouldn't take the chance.

Are you in CA? If you are the answer is no.

It does become an SBR and would need a Form 1 and $200 Tax Stamp.

          Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

Depends on if you have BATFE approval and CA DOJ approval for it.

If you have BATFE approval and CA DOJ approval, then yes.

If you do not have BATFE approval and CA DOJ approval, then no.

Mere possession of it and an unattached handgun that can utilize it meets the CA definition of a SBR [PC 17170(e)], which is a felony to possess unless you have approval from BATFE and CA DOJ [PC 33215].

              Penal Code 17170
As used in this part, “short-barreled rifle” means any of the following:
              (a) A rifle having a barrel or barrels of less than 16 inches in length.
              (b) A rifle with an overall length of less than 26 inches.
              (c) Any weapon made from a rifle (whether by alteration, modification, or otherwise) if that weapon, as modified, has an overall length of less than 26 inches or a barrel or barrels of less than 16 inches in length.
              (d) Any device that may be readily restored to fire a fixed cartridge which, when so restored, is a device defined in subdivisions (a) to (c), inclusive.
              (e) Any part, or combination of parts, designed and intended to convert a device into a device defined in subdivisions (a) to (c), inclusive, or any combination of parts from which a device defined in subdivisions (a) to (c), inclusive, may be readily assembled if those parts are in the possession or under the control of the same person.

              Penal Code 33215
Except as provided in Sections 33220 and 33225 and in Chapter 1 (commencing with Section 17700) of Division 2 of Title 2, any person in this state who manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or exposes for sale, or who gives, lends, or possesses any short-barreled rifle or short-barreled shotgun is punishable by imprisonment in a county jail not exceeding one year or imprisonment pursuant to subdivision (h) of Section 1170.

CA or otherwise, the MCK's with stocks are NFA items and will need the tax stamp.

                  Not correct.
                  They are just stocks.
If a pistol is inserted then the pistol must be a registered sbr or machine gun. I have one of these and put my selectfire Glock in it.

That's odd. I'm a CAA dealer. Every MCK in their inventory that actually has a stock and not a stabilizer are marked as NFA items requiring a stamp in all the literature they've sent me.

If you have a pistol or pistol lower alone, yes, but if you have an AR rifle then no. However, if you only have AR rifles in your possession and you have a short AR barrel (less than 16") you can get charged with constructive possession of a SBR.

A stock is not a firearm. How can a stock require a stamp?
If it did require a stamp then it needs to already be on a form 3 from the manufacturer if it fall under the NFA/GCA. How many form 3s do you have with those stocks?

Stick a glock into an mck and the glock needs to have engraving and a stamp but not the stock.
