    Curio & Relic transfer question

    Hello Calgunners,
    I've a question regarding the transfer of a C&R ( SKS Type 56 ), from my father, to me.
    Are there and steps that I need to take, in order to receive this rifle, or is it a matter of just receiving the rifle?
    I researched this and couldn't find a definitive answer.
    I appreciate Calguns, and all of its members, very much.

    Receive the rifle and note the rifle details in your bound book.

      You didn’t state if you have a FFL03.
      Is your father in CA?
      If not, then it must go through a CA FFL. discuss the transfer with the receiving FFL and they will give you specifics of what they need to happen

        If you and your father are both California residents, he can transfer it to you on a act-of-law form:


        If you are in California and your father is outside of California, he can mail it to a California FFL who will do the transfer to you.

        If you are a licensed 03 FFL and you visit your father in a state outside of California, he can give it to you and you can put it in your bound book and notify the state of California on this form when you import it into California:


        If both you and your father reside in the same state outside California and your state has no private party transfer laws (Nevada does), your father can just give it to you.

        Crossing state lines requires an FFL.
        If YOU are not an FFL, one will have to be involved.
        If YOU are an FFL, then the state only needs you to report that you have received it so they can register it to you.

              That is correct only if the OP is not an 03 C&R FFL holder.

              If he's an 03 C&R FFL holder he needs to use the Collector's Report of Instate Acquisition of Curio or Relic Long Gun (BOF 961)

              This information is incorrect and the form you linked is the wrong form.

              Even as a licensed 03 C&R FFL holder you still have to abide by the laws of the state you are in. NV is now a state that requires all transfers to be done at an FFL and there is no exemption for C&R firearms or those who hold 03 C&R FFL's. OR is another state that requires all transfers to go through an FFL, I also don't know if they have a C&R/C&R FFL exemption.

              And if you acquire a C&R firearm while out of the state of CA as a licensed 03 C&R FFL holder you need to use the Curio or Relic Firearm Report (BOF 4100A)

                  --Neither I, nor my father, possess a Curio & Relic FFL license.

                  ---The Type 56 SKS is a 1950's rifle.

                  ---Is the consensus that we need to fill out an Intra-Family Transfer for the BATF / DOJ?

                    You will need a firearms safety certificate or proof of something else that exempts you from the requirement such as a hunting license.

                      BATF doesn't care. The form is all CA DOJ which gets $19.

                        Instead of the litany of hypos and information provided, the following would have been helpful from the start.it looks like you've since provided that information.

                        Do you have a COE?

                        Do you have an FFL03?

                        Is your father a CA resident?

                        Do you have an FSC?

                        There is no such transfer/form. Being "familiar" or "intra-familiar' with someone doesn't help you. Being a specific type of family/familial relationship does. The Op-law Intrafamilial form is what you're looking for.
