Father passed away, please help with his guns

    Father passed away, please help with his guns

    This is regarding two guns my Father purchased in 2018 at a gun store while he was a resident in South Dakota. They are - a 9mm M&P Shield 2.0, and a 12-guage shotgun.

    In Feb 2021 he officially changed his residence to CA, and got a CA drivers license. The BIG question is whether or not he registered these guns here in CA before he passed.

    1. How can I find out if he registered them here?
    2. What happens if he did not?
    3. If he did, can I just walk into an FFL with a death certificate and get them put into my name?

    If he was a CA resident when he died, just complete and submit the operation of law form (intrafamilial) and stop overthinking and worrying about it.

      Ohsmily is correct. So long as pops was a CA resident and all of the other legal stuff is taken care of you just need to feel out the OpLaw form.

      Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

        I agree. File the form, no need to visit a FFL and no need to worry about if he registered them or not when he moved here. They will be registered to you when the form is filed.

            Thanks for all the good messages.. Didn't know it was that simple, so I went online to the CFARS site and submitted the Intra-Familial Transfer Reports.

              Sorry for your loss. Last time I filled out that form it took 3 months to get the letter that they were reg to me.

                      What would the case be if his father was a CA resident then moved to a different state but his ca registered guns were left in CA ?

                        The same. It would also be the same if the father had removed the guns from the state before he died; one of the few exceptions to the requirement that guns moving ownership interstate going through an FFL.

                          So all that would be required is a filling out of the form , and in the meantime the firearms could be legally shot responsibly?

                            So even if father who has since passed away moved out of state and took guns with him, a CA child only needs to fill out the intrafamiliar transfer form and thats it? No shipping of guns, no shipping to CA FFL either?

                            Obviously wait till transfer was competed to bring in CA correct?
