Interestingly, part of the Treaty of Guadalupe Hidalgo is the insistence that all Mexicans who chose to stay on the U.S. side of the border be granted full citizenship as white people. Mexico has consistently insisted that all Mexicans be treated as "white" for government purposes. So, by treaty, Latino is an ethnicity because the Government is required to treat all Latinos as "white."
