Someone I met just got through the DROS on a new rifle he got shipped to a local FFL from out of state and neither the FFL or retailer who shipped it out charged tax. Any repercussions from this or will he get charged tax when he goes to pick it up after the waiting period?

He owes the tax regardless. He can file with ftb and pay it direct. The receiving ffl will owe the tax if not paid. -

What? This wasn't a PPT, it was a dealer transfer. Most dealers are charging a good fee for their service. The dealers on the low end are charging $60 now a days, though there may be one or two charging less.
I don't know this guy so I can't say. But, I would hope that he would step up and do the right thing and let the dealer know that he needs to pay the tax on this rifle.Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

If a FFL dealer overcharges on Dros or adds on unnecessary fees on dros, will the FFL notify the customer that he overpaid and give a refund of the differences?
Just as we customers need to inspect the dros form for errors and the firearm for faults before release, it would have to be on the FFL to inspect papers and firearm for release.Last edited by CheapBloke; 05-14-2021, 8:21 AM.Comment

That happened to my LGS in Nevada. He had been transferring firearms without charging tax, not knowing that he was to collect it. There was a time when interstate sales were done without the FFL having to collect the taxes and when it changed, he somehow did not get the notice. Finally the state came and hit him with a $48,000 bill for owed sales taxes. I felt bad for the guy and I let him sell a bunch of my ammo at 30% consignment to make up for his losses.sigpic

If the California FFL never collected the tax, and the seller never collected any tax, and the end purchaser never declares it, that very likely is the end of it. The FTB would have to audit the California FFL, and even in that rare case, it would likely go unnoticed.
