Not any more. Got an email from ebay stating they are going to do their own thing.

They can judge anything as a "prohibited part" at any time.

I would never ever link PayPal to a bank account. I use AMEX instead.

still don't understand why calguns uses paypal to collect subscription fees. all these banner ads and vendor forums are funding paypal.

You are correct: PayPal and ebay are actually two separate entities. ebay does own PayPal, and are connected but operate separately.

I don't think that the liquidated damages provision in the contract is enforceable. I think they need to be sued in the superior court to see if we can make them stop what they are doing. If anyone has a similar horror story and is interested in trying to get their pound of flesh from Paypal, please feel free to send me a PM.
Are you saying you are going to continue using their service after they stole your money? What damages were incurred that justifies taking $400?

We’ve been through hell many times with PayPal on my wife’s eBay side business.

They’re terrible to work with. We’ve had large of amounts held for no reason after doing 100’s of invoices for her bakery business. Our latest one was a $1300 loss over baked goods that were deemed offensive.

You can send money through many electronic means, Zelle, cashapp. I don't think they have the guarantees that paypal has if you don't get your merchandise, or damaged, etc.

Oh that's good! What's the backstory on the "offensive" baked goods?

For what it's worth, PayPal owns venmo and they have all the same rules.

Well that's the crux of the potential case against them. They just say that damages are likely to be $2,500 and therefore they seize whatever you have in your PayPal account up to $2,500.

Liquidated damages like this are disfavored and the courts only enforce them when they can show an attempt to approximate actual damages. Here I think PayPal just picked $2,500 bucks because that's more money than anyone ever has in their PayPal account and decided to run with it.

I kind of think the courts would side with me. PayPal also has a provision against class actions, but I think I know a way around it.

Good luck, suing PayPal isn't like going to Carl's Jr.

Did someone complain? Hahaha! I assume the ones ordering were the ones paying and knew what they were getting. Who decided they were "Offensive"? Such a dumb policy.
