He has a federal ban, moving will not help. Lawyer is the only way.

I do wonder if 1203.4 expungement would do it for him? We all know that a 1203.4 is not recognized by CA as a restoration of gun rights lost for a felony conviction. But OP only has a misdemeanor, and CA only imposes a 10yr gun ban for that if it was DV related. It seems a 1203.4 might be recognized by the feds, because it is a withdraw of guilty plea and set aside of conviction.

But according to this article, a 1203.4 will not help either - the feds will not recognize it
Oooops, looks like the page you requested could not be found. Please check the URL for proper spelling and capitalization.

OP's best and maybe only chance to keep his gun rights was before pleading guilty to a DV related charge. A good lawyer would have tried to plea guilty to anything else but the DV with violence.

I am afraid he is right. Perversely in CA, the governor cannot pardon misdemeanors. He could pardon a felony murderer and restore his gun rights (although that would be a long shot) - but cannot pardon anyone who did not go to state prison.

You should be eligible to own black powder firearms though. Your state firearms prohibition has been lifted, and federally - MCDV folks can own black powder guns
This question involves the intersection of two complex areas of firearms law: The federal prohibition triggered by a misdemeanor conviction of a crime of domestic violence; and Whether black powder firearms are considered ‘firearms’ under state and federal law. Let’s … Continue reading →

No offense, but I'm not surprised if he sounded rushed; did you seriously call him at around 8am the day after the biggest presidential election in history??

Not being a jerk, but you should have waited til at least 10-11am.

Everyone's always rushing & busy in the morning.

OP, you can proceed with good legal representation to restore rights taken away from you.. as long you are aware of the cost involved and potential of publicizing your past conviction....
