Flare Gun Insert Legalities

    Not really on topic, but sort of . . . I was in my boat and came across a floating orange cylinder. Turns out it was a brand new Olin Flare-Gun kit . . totally dry inside . . . really nice kit. Even had a couple of those flares that have the 'parachute' attached for a slower fall. All were still current and not expired. The gun seems well made, all metal etc. . But I'd have ZERO interest in shooting a flare from it, in anything but an extreme emergency . . . even then it seems sketchy.

      well you know those pro-fireworks are launched in cardboard tubes about the same size carpet comes on

          On 05-04-2006, BATFE FTB has determined that installing an insert into a flare launcher so that it can discharge firearm ammunition makes the device a Title 2 AOW.

          In order to legally do this under Federal laws/regulations, the person must obtain BATFE approval to make a Title 2 AOW ($200 tax stamp) prior to making the device.
          Failure to do so equates to a Federal felony.

            So Federal laws apply, I was thinking a person could have gone through the trouble to legally "build" a flare gun into a CA dimensionally compliant single shot break open pistol.

                  I'm just amazed anybody would actually want these. Why would anyone want to shoot a cartridge out of a less than optimal platform, where accuracy and performance are going to be downright terrible? Its not a matter if you could, its all about if you should. Definitely shouldn't. Then again, people seem to want to Darwin themselves on the daily, so I guess I shouldn't be surprised.
