FFL won't return my weapon, says it's AW (Resolved correctly 8-6-20)

          What about the muzzle brake/flash hider on the barrel?
          Is that a brake, or is that a flashhider and thus a "feature"?

              A 'bullet button' no longer serves to make a magazine 'non removable'. Very old law --
              12276.1. (a) Notwithstanding Section 12276, "assault weapon"

              to accept any ammunition feeding device that can be removed
              readily from the firearm with neither disassembly of the
              firearm action nor use of a tool being required

              Prior to the law change, a 'bullet button' DID make a magazine 'non removable', and so the first part of the 'assault weapon' test passed. That is, such bullet-buttton-equipped rifles were legal, and 'features' were permitted, so long as one stuck with 10-round mags.

              Once the law changed, and DOJ required/allowed registration, they demanded that any bullet buttons remain on the registered guns.

              Under the new law, a bullet button has no legal significance whatsoever.

                A bullet button NO LONGER satisfies the requirement that a magazine is FIXED but that does not matter for featureless.
                If you configure a gun as a fixed magazine and you can remove the magazine with a tool WITHOUT "disassembly of the action", it is indeed an assault weapon.

                FFL is confused on what featureless is.
                You confused him by leaving a bullet button on the gun.
                If the gun has a large capacity magazine with it, it could be considered an AW because the magazine holds more than 10 rounds AND is fixed in place, even though bullet buttons are no longer considered "fixed"...

                  The purpose of a Bullet Button was to create a fixed magazine. It no longer serves that purpose due to a change in the law. It is permissible, and probably wise from a functional point of view, to remove a Bullet Button from a featureless semi-auto rifle.

                  If a semi-auto rifle is featureless, does not have a fixed magazine of more than 10 rounds, is not on the "evil by name" list, and is not on the "evil because the judge said so" list, then it cannot be an Assault Weapon.

                  As to your second posting, you seem to have left something out. You refer to the "the current AW redefinition here", but then there ain't no "there". What are you referring to?

                  You may want to give some close study to Penal Code section 30515 before responding.

                        Ok let's clarify- dude says he has a fin on it to be featureless. Ok, but I'm not saying it doesn't, just saying that (conjecture because FFL isn't here) but as we know, this gun obviously was sold as maglocked and since it still has the bullet button on it, I'm saying that if it was registered as an AW as things with bullet buttons were required to after '17, it's a RAW and can't be transferred, or an URAW either way.
                        I think we all know the owner took the no-registration featureless route and says he put a fin on, but should have either removed the BB or at least clarified it before handing it over to said FFL to avoid this mess. Does that sound like what is happening here? I have no idea why guys would featureless something and keep the BB on it. It just clouds things up and doesn't make it "less assaulty"
