    Won a CJIS firearm related challenge.

    Hello all I recently won a denied DROS appeal. The FFL doesn't know how to proceed and said the DOJ didn't answer his call and he doesn't have time to keep calling back.

    I received a FBI CJIS firearm related challenge certificate?

    Does anyone have exprerience with the process?

      I would find an FFL that will deal with it, and then have the non working FFL send them the gun, and go from there.

        Thank you very much.. It's been a long process. I won and still cant pick up the pistol and rifle I have paid for. D'oh

            Im in the LA area that borderlines the OC area if any FFL that reads this can help. I have all my paperwork and receipts.

              How long ago was the denial? Does the FFL still have the gun? If the FFL still has the gun on hold for you, fax the challenge cert to DOJ and then wardial to reach someone there or have the FFL help you. The DOJ can process an approval after denial. If the FFL does not have the gun, then the challenge cert is not as meaningful.

              Also, you should apply for a Voluntary Appeal File at FBI NICS. That should go quicker since you have a recent challenge cert. If you don’t do this, FBI may deny you again and again. If you get the VAF, FBI will keep the info on file that won your challenge.

              When you get the UPIN after getting the VAF, be sure and get the UPIN to CA DOJ and have them update notes on your record with the UPIN.

                Yes the FFL still has the gun. The denial was mid December. The cert says it can be used to redo NICS check through the State POC with and create a special NTN that can used 1 time and for multiple guns (1 rifle and 1 pistol)

                The FFL is trying to DROS again without following the procedure. He said he would not charge me a DROS fee. I think im might just ask him to let me keep calling and hand him the phone once the DOJ responds. I'll mention to him about faxing the paperwork.

                I have emailed the cert and dros info to the doj and they gave me a canned answer that they can not discuss personal information. All i asked was if the DOJ could contact the same FFL they already talked to in order to obtain the original NTN for the appeal and walk him though the process.

                Since it's longer then 30 days they must rerun the background check. I think it will get denied again since the FFL is to busy to handle it correctly.

                The Corona Virus issue is really making this harder to get done. Making the FFL to busy to do his job for me.

                I have the VAF ready to mail out. I emailed the VAF to the FBI today asking if they would accept it electronically. I'll mail it out if i dont hear back from them on Mondayct.

                My FBI background is clean. I had a prop 64 disposition change In April 2019 and the state DOJ is the one that denied it. The state DOJ is still in the process in doing the record review to correct my stat record.

                  Wait for your state record review. Your state record needs to be cleaned up. Then find out from DOJ if they want the FFL to DROS again, or if they will issue an ‘approval after denial’ on the original DROS.

                    Thanks the Sound advice.
                    The DOJ Bureau of Firearms directed me to go through the CJIS. They directed the FFL to obtain the FFL. Now its hust the last part to obtain the special NTN number that will confirm my identity and my clearance. Im give it one last shot. Maybe buy all the ffl employees lunch for their time.

                          At this point, what good is using a different FFL going to do you? The challenge cert is only good at the original FFL.



                          Successful Appeal
                          Failure to submit all required appeal information may result in the rejection of your appeal request.
                          NOTE: Specific appeal information can only be provided to you once positive proof of identity has been established via the submission of your fingerprints.
                          If your appeal is successful, you will be notified by the AST, via U.S. mail, your denial has been overturned and you currently have no firearm prohibitions. You will be issued documentation which must be presented to the Federal Firearms Licensee who initiated your background check.
                          Now it may be slightly different since in CA, the DOJ is the one who initiates NICS background checks. But I don’t think switching FFLs is going to gain you anything. You need to convince DOJ that you are good to go, not another FFL.

                            The paperwork has some instructions. Ill try to fill in the blanks. i went to the current FFL's store and provided the certification.

                            The CJIS overturned denial. They assigned has a special code that would bypass the erroneous denail. It reruns the NICS check
                            with a special 1 time NTN number. It doesnt have to be for the same firearm. Its a backgroud denial overturn. I have to redros but under that NTN.. i can have any amount of firearms that is allowed by the state to purchase at once. California is POC only state.

                            So knowing this, I pay for an overpriced CZ 75D. I managed to obtain their last one.

                            So we then do the DROS paperwork for the pistol and rifle. I figure everthing is working smoothly. The FFL' tells me the DOJ POC (point of contact ) didnt answer the phone. So he just DROSed them normally.

                            I was like what? You need to do it the way the paperwork says.. he says ill just give you a full refund. I said no thanks I have the paperwork and we can work it out. He told me to have to DOJ contact them

                            I paid for the rifle in mid December. The rifle is now selling for way more then i paid for it.
                            The DOJ is sent me the canned "we can not discuss personal info response" .

                            Im going to offer all 4 employees lunch and see what happens. Ill do the calling for them. Lol

                              Update. 11 days and the dros is still pending. The DOJ is not answering calls from FFL or emails.
