        Excellent post. This is right on point to the OP's concern.

        It's also important to note that the definition of "Indictment" as used in 18 USC 922 is a little different from the common understanding of the word.

        Indictments are issued by Grand Juries. In the federal realm, they are quite common due to the Fifth Amendment's guarantee of the right to an indictment in felony cases.

        That part of the Fifth Amendment does not apply to the states, and it's quite rare for cases to prosecuted by indictment in California. Felonies in California are normally prosecuted via an "Information" issued by a prosecutor.

        At first blush, one would think that a person charged with a felony, but not under indictment would not fall under the federal provision.

        But they do. The definition of "Indictment" as contained in 18 USC 921 includes cases where a person has been charged via information, but not indicted.
