    I have a legality question

    So I know this is soon for me but. My uncle just passed and his partner is laying claim to property that is not his.

    To preface my grandfather passed four years ago . he owned several weapons and verbally told my grandmother who gets them.
    My uncle being the one who got most of them.
    Here is the catch they all lived under the same roof so the weapons my uncle had are hidden away. And the were never legally transferred to him through interfamilial transfers
    ...in this case my assumption is that my grandmother is the sole execution of his estate(including the weapons)

    my worry is that the weapons in question had Ben in my family for several generations and I wanted to keep it that way ...my grandmother has the same idea and agrees that they are mine .

    but I need their info to do an interfamilial transfer from her to me as I'm legal

    ...also said spouse has a medical marijuana card so that's an issue

    Please any advice would be great.

    My other worry is he illegally sells them

    If he is a user of Marijuana, he cannot legally be in possession of any firearms or ammunition.

        Depends on how far you want to push it. You can always threaten to report him to the local PD.

          Do you know what would happen if I did that ? Would the cops just be like give this other dude the guns? If my grandmother still legally owned them

                  Then you may have to go to court, that will be expensive. And if you take them you might be reported for theft, also a bad deal.

                      If I take them and do an interfamilial transfer from my grandmother witch she approves btw then how can he get me for theft

                        If there is no written will, doesn’t ownership pass from the grandfather to the grandmother upon the grandfathers passing? If so, then the uncle doesn’t have any right to the guns without grandmas blessing.

                          If they were your grandfather's then they are your grandmother's. Joint property. If they were never transferred to uncle then they were never his and never his husband's. He has no claim to them. Get a lawyer to sort it out, send a letter to husband of dead uncle.

                              OP not bright enough to say what state all the parties are in. If interstate then must go thru ffl and uncle not eligble for intrafamilial plus with mj card no transfer regardless.
