when does a ppt count considering the 5 in 1 year rule

    when does a ppt count considering the 5 in 1 year rule

    ...asking for a friend...

    1) Does the PPT limit of 5 per year cover a 12 month period or does it reset to 0 on Jan 1?

    2) If it resets on Jan 1 and a PPT started in late Dec but buyer picked up in early Jan, does it count as 1 under last year's count or the new year's count?

    3) Would an FFL refuse a PPT if friend was at limit?

    4) I search on here and there has been no "enforcement" but friend would rather side with caution and not end up on any "Watch Lists" and just wanted to sell off stuff to buy something more expensive.

    im not sure, but from what i've interpreted it's based on 365 days which starts after that first PPT

    that's what a friend told me

      FFL has nothing todo with it. 5 in one year only for handguns use search.

          Pick-up date has nothing to do with it either, since it regulate's the seller.

            I haven't kept up with the laws since 2017, but this is what I remember, so please someone correct me if this is incorrect:

            1) 5 per year limit is only for SELLING & not buying. Selling starts counting January 1. PPT BUYING is excluded from the 5 per year limit

            2) I'm pretty sure it's DROS date that counts

            3) FFL wouldn't refuse. Supposedly, you would "raise a red flag" with CA DOJ if you SELL more than 5 per year

              The only limit on buying is 1-in-30 for handguns. PPT are exempt from that though.

                    For selling handguns, its 5 transactions per year. One transaction can be for one or more than one handgun.

                      So what happens if you sell your personal property and have 10, 20, or 30 transactions for a year or two?

                      If you're not acting like an unlicensed dealer, what law would you be breaking?

                            I would if I had that many. Moving is a pain in the ***, less stuff is better.

                            If I legally own 10, 50, 200, or 500 guns and decide to sell them all individually, what law would I be breaking?

                            "Infrequently" is a law meant to enforce FFL licensing and selling as a business.
