    Restocking fee?

So i had a DROS get delayed, and the gun store owner wouldnt believe me, or my lawyer that after 3 days its considered clear and they can release(refused to talk with doj "im busy" when i was only customer in store).

So I asked for a refund... seems their policy is to take the before tax price, and subtract tax amount, and a extra $25. so i paid $265.27 restocking fee on a $1200(before tax) gun.

    (original $94.62 tax + $94.62 + $35 dros + $25 +some random $16)

Does this sound excessive or about right?

WOW! Sounds like free money to me. How did he validate it to you?

I bet he really went out of his way to "restock" the gun. What, he reached over and put it back in the case? Or he had to put it in the back? Maybe he figures you made him get off his stool and burn a couple of calories. Just another rip-off. I wouldn't go back to that store.

I was so incredibly angry at the time if i opened my mouth it would have resulted in being kicked from the store and getting no refund at all lol.

Good call man. That is pretty crappy to hear bro. Like the other guy said I wouldnt frequent that shop.

Have you thought about going back and getting some questions answered?

I mean, how could they claim that on their sales? No service was rendered besides the background investigation, and you paid them to do that. That seems like some serious gray area that needs to be explained.

This sounds like something the Better Business should hear.

im hesitant to name names, as the store has been good to ALOT of people here in the past, and the employees frequent the board.

hell why didnt you just ask for him to dros you again that and tell him you cleared up the issue

another $25 is better than paying 10 times that and geting nothing

I think this is something everyone should question.

Is this true? I know that with a NICS delay, it is ok to release after 3 days if the FBI doesn't call back, but is it the same for the DROS? I had never heard that about a DROS.

If it was me, I'd take the time to get it cleared up with DOJ, and to have them call him or send him a letter showing that the delay was released before I did a "restock". You've got 30-days from DROS submittion before it goes stale to get that accomplished.

Do you want an AOW or C&R SBS/SBR in CA?

That doesnt sound right to me, I have seen DOJ delays take up to 3 months to clear. Once the DOJ puts a DROS on delay, the dealer has to wait for a clearance letter from the DOJ to release the firearm.

Let me ask you this, did you agree to restocking fee before making the purchase?

My lawyer is working on getting it cleared at the moment, and hes the one that told me about the 3 days thing(he is a gun lawyer). it will likely be a while before its all clear though, as it involves a false arrest and subsequent case burying by the PD.

there could be a sign or something on the wall which i missed, doubtful though. if this is regular policy we should hear from an employee of the store soon as he would recognize it.

Turner's puts the cancellation charge (that you initial) right on the DROS form invoice that you sign. I don't have an DROS form invoice from another dealer to see if it is the same or not.
