    Introoder

    About a year ago someone broke into my garage in early morning hours. I took the trash out that morning and noticed my garage door was pulled open half way. As I lifted the door up the rest of the way I noticed my trunk and drivers side door open. Upon further inspection I noticed many things missing from my garage. I also noticed I hadn't locked the door connecting my garage to my condo. As I filled out the police report with the officer I asked, if the perp would have entered my condo while I was asleep and woke up, is it within my rights to defend myself and shoot. The officer stated "as long as you don't shoot him/her in the back and the incident happened inside your residence, you are within your rights to defend yourself". Any thoughts? Shoot to kill or warning shot?

    Cop said "defend yourSELF,".
    Do not shoot to protect property.

    Call for help if at all possible.

        I would shoot to kill then fire some warning shots.

          If you shoot an intruder shoot to kill. Not sure about CA but in NJ you have a duty to retreat from your home. However if you meet intruder downstairs and your family is upstairs you have no safe escape without putting them in danger. If alone and and you can run out the backdoor, in NJ you are expected to flee your home. I can't wait for the day I move to Free America.

                i think that in california your best bet would be not to use a gun. but if you had to use a gun(life or death situtation), it would be wise to shoot at the target with the intention of stopping the threat.

                  Too much bad advice.

                  Shoot ONLY to "stop a threat." If the attacker dies, oh well. No warning shots - nothing says "I wasn't in fear for my life" like a warning shot. Stop shooting when the threat stops. No sooner and, more importantly, no later.

                          Crazy thing, it was a girl. I got half of my stuff back 8 months later. They raided her crack head apartment and found she had been breaking into places for years. They released her a few days later.
